AN ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF SANTA MONICA
ADDING SECTION 4138 TO THE SANTA
MONICA MUNICIPAL CODE, PERTAINING
TO THE FEEDING OF PIGEONS AND OTEER BIRDS
AND ANIMALS AT THE SANTA MONICA
MALL.
THE CITY COUNCIL OF THE CITY OF S~~TA MONICA DOES
ORDAIN AS FOLLOWS:
SECTION 1.
Sectlon 4138 lS hereby added to the
Santa Monlca Munlcipal Code to read as follows:
Section 4138. Feedlng of plgeons and other birds
and anlmals. ~o person shall, in the area described In ~3611 of
thlS code, do any of the followlng:
a. Feed any pigeon, or any other blrd
or animal upon any public street, sidewalk, mall or way; or
b. Dlsperse any food materlal or other
matter edlble by pigeons, or any other blrd or anlmal so as
to make such materlal or matter avallable to plgeons, other
blrds or anlmals for lngestlon; or,
c. Permlt any food or other matter
edible by plgeons, or any other blrd or anlmal to remaln on
the ground after disperslng or dropPlng the same.
d. Any person vlo1atlng any of the
prOV1Slons of thlS sectlon shall be gU11ty of an lnfractlon.
Any person convicted of an lnfractlon under the provislons
of thlS sectlon shall be punlshable by a flne of not less
than $5.00 and not more than $25.00. Each such person shall
be gUl1ty of a separate offense for each and every commlssion

of any vlolatlon of any provislon of thlS sectlon and shall
be punlshed accordlngly.
SECTION 2.
Any provlslons of the Santa Monlca
Munlcipal Code, or appendices thereto inconsistent herewlth,
to the extent of such 1ncons1stencles and no further, are
hereby repealed or modified to that extent necessary to effect
the provlslons of th1S ord1nance.
SECTION 3.
If any sectlon, subsection, sentence,
clause or phrase of this ordinance 1S for any reason held to
be lnvalid or unconstltutional by a declslon of any court of
competent ]urlsdictlon, such declslon shall not affect the
valldlty of the rema1ning portions of the ordinance. The
Clty Counel1 hereby declares that lt would have passed th1S
ord1nance and each and every section, subsectlon, sentence,
clause or phrase not declared 1nval1d or unconstltutlonal
w1thout regard to whether any port1on of the ordinance would
be subsequently declared lnvalid or unconstitutional.
SECTION 4.
The Mayor shall slgn and the C1ty
Clerk shall attest to the passage of this ordlnance. The
C1ty Clerk shall cause the same to be published once ln the
officlal newspaper wlthin flfteen (15) days after lts adoption.
The ord1nance shall become effectlve after th1rty (30) days
from lts adopt1on.
