O1026 e e ORDINANCE NO. l026(CCS) (City Council Series) AN ORDINANCE OF THE CITY COUNCIL OF rliE CITY OF SANTA MONICA AMENDING SECTIONS 3400, 3401, 3402, 3404 AND 3406 AND ADDING SECTION 3407 PERTAINING TO BICYCLE LICENSING. T~E CITY COUNCIL OF THE CITY OF SANTA MONICA DOE0 ORDAIN AS FOLLOWS: SECTION 1. Section 3400 of the Santa Monica Municipal Code lS hereby amended and shall read as follows: Secbon 3400. BICYCLE DEFINED. For the purposes of this section "bicycle" shall mean any device upon which a person may ride, which is propelled by human power through a system of belts, chains or gears and whlch has either two or three wheels (one of which is at least 20 inches in diameter, In tandem or tricycle arrangement) or a frame size of at least 14 inches. SECTION 2. Section 3401 of the Santa Monica Municipal Code is hereby amended and shall read as follows: Section 3401. LICENSE APPLICATION. A:ny person desiring to operate or use a bicycle upon any of the streets of the City shall apply therefor to the City Clerk or bicycle retailer (authorized agent) who shall record the name and address of the owner thereof and a descript~on of said bicycle. The City Clerk or author~zed agent shall issue the license requested upon payment by the applicant of the fee herein required. Said license when issued shall entitle the licensee to operate said bicycle for which said license has been issued upon all the streets, exclusive of the sidewalks thereof or elsewhere prohiblted in the City. SECTION 3. Section 3402 of the Santa Monica Municipal Code is hereby a~ended and shall read as follows: Section 3402. REGISTRATION. The City shall provide license receipts and decals purcha"ed from the Department of Motor Vehlcles of the State of California as well as certificates or other forms required by state law for the licenslng of bicycles and distribute these to its duly authorized agents upon written application and payment therefor. Upon receipt of the requlred blcycle license fee, it shall be the duty of each licensee to attach in a conspicuous place such decal to the frame of the bicycle for which issued. The license rece~pt shall show the name, address, phone number, if any, of the person to whom the bicycle is registered, as well as the name or make, model and serial number of the bicycle. A copy of the l~cense receipt shall also be f~led with the Police Department. SECTION 4. Sect~on 3404 of the Santa Monlca Municipal Code is hereby amended and shall read as follows: -1- e e append~ces thereto inconsistent herewith, to the extent of such inconsistencles and no further, are hereby repealed or modlfied to that extent necessary to effect the provisions of th~s ordinance. SECTION 8. If any section, subsection, sentence, clause or phrase of this ordlnance is for any reason held to be lnvalld or unconstitutlonal by a declsion of any court of co~petent Jurisdictlon, such decision shall not affect the validity of the remaining portions of the ordinance. The City Counc~l hereby declares that it would have passed thlS ordlnance ~~d each and every section, subsect~on, sentence, clause or phrase not declared invalid or unconstltutional without regard to whether any portion of the ordlnance would be subsequently declared lnvalid or unconstitutional. SECTION 9. The Mayor shall sign and the City Clerk shall attest to the passage of thlS ordinance. The Clty Clerk shall cause the same to be published once ~n the cfflcial newspaper withln fiften (15) days after ltS adoption.
