AN ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF SANTA MONICA ADDING
SECTION 6116A TO THE SANTA HONICA
MUNICIPAL CODE, PERTAINING TO
REFUND OF BUSINESS LICENSE TAX
OVERPAYHENTS.
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES
ORDAIN AS FOLLOWS:
SECTION 1.
Seetlon 6116A lS hereby added to the
Santa ~1onica Hunicipal Code, to read as follows:
Section 6ll6A. Refund of gross reee~pts tax
overpayments. In all cases provlded for 1n sect~on 6116 of
thlS code where an overpayment is made lh the amount of $9.99
or less, the amount of such overpayment shall be credited to
the renewal of the license 1hvolved ~n the year folloWlhg such
overpayment, provlded that the cred~t authorlzat1on notice is
returned by the person or organlzatlon having made the
overpayment. Cash refunds of such gross recelpt tax overpayments
may be obtalned, ln the case of a bus1ness whlch lS term1nated
prlor to the beglnning of the next ensulng license year followlng
overpayment, by flllng a clalm for such cash refund.
SECTION 2. Any prov~s~ons of the Santa Monica
MunlClpal Code, or appendices thereto inconsistent herewlth,
to the extent of such lncons1stenc1es and no further, are
hereby repealed or modlf1ed to that extent necessary to effect
the provls1ons of th~s ordlnance.
SECTION 3. If any sect~on, subsectlon, sentence,
clause or phrase of th~s ordlnance lS for any reason held to

be InvalId or unconstItutIonal by a decIsIon of any court of
competent JurisdIctIon, such decision shall not affect the
validIty of the remaining portIons of the ordInance. The
CIty CounCIl hereby declares that It would have passed thIS
ordlnance and each and every sectlon, subsectIon, sentence,
clause or phrase not declared Invalid or unconstItutIonal
WIthout regard to whether any portIon of the ordInance would
be subsequently declared Invalid or unconstitutIonal.
SECTION 4.
The Mayor shall sign and the CIty Clerk
shall attest to the passage of thIS ordInance. The CIty Clerk
shall cause the same to be publIshed once In the offICIal news-
paper WIthIn fIfteen (15) days after Its adoption. The ordInance
shall become effectIve after thirty (30) days from lts adoptIon.
