O1021 CA ~IS:Cam 12-11-75 _ ORDINANCE NO. 1021 (ecs) (City Council Ser~es) AN ORDINANCE OF THE CITY OF SANTA MONICA, CALIFORNIA APPROVING AND ADOPTING THE REDEVELOPMENT PLfu~ FOR THE DOWNTOWN REDEVELOPMENT PROJECT WHEREAS, the Redevelopment Agency of the C1ty of Santa Honica ~here~nafter referred to as the "Agency") form- ulated and prepared the proposed Redevelopment Plan for the Downtown Redevelopment ProJect; and, WHEREAS, the Planning Commlssion of the Clty of Santa Mon1ca has submltted its report and recommendatlon, flndlng sald proposed Redevelopment Plan to be ln conformity wlth the General Plan and recommendlng approval of sald proposed Redevelopment Plan; and, WHEREAS, the Agency adopted rules governlng partlcl- patlon by and reasonable preferences to owners and tenants ln the ProJect area; and, WHEREAS, the Agency subm~tted to the Clty Council of the C1ty of Santa Monlca sald proposed Redevelopment Plan accompanied by the Report of the Agency and the Envlron- mental Impact Report on sald proposed Redevelopment Plan; and, WHEREAS, after due not~ce, a joint publ~c hearing was held by th~s Council acting as the Agency and the City Counell to consider the proposed Redevelopment Plan for the PrOJect; and, WHEREAS, at sald Joint public hearlng thlS Councll heard and passed upon all oral and wrltten Ob]ectlons by overrullng such Ob]ectlons; and, -1- - e WHEREAS, all actLon requLred by law has been taken by all approprLate publLc agencies; NOW, THEREFORE, THE PEOPLE OF THE CITY OF SANTA MONICA DO ORDAIN AS FOLLOWS: SECTION 1. The purposes and lntent of the City Counc~l with respect to the ProJect area are to: (1) Elimlnate the conditlons of blight eXLstlng in the ProJect area; (2) Insure, as far as posslble, that the causes of blightlng condltlons wlll be elther elLffilnated or protected agaLnst; (3) Provlde participation for owners and a reasonable preference for persons engaged in business in the ProJect area; (4) Encourage and Lnsure the rehabilitation, rebulldlng, and development of the Project area; (5) Encourage and foster the economlC reV1- tallzation of the ProJect area; (6) Relocate the owners and occupants of the ProJect area as needed; (7) Redevelop and rebuild the publlc faCl11ties 1n the Project area to provLde safer and more efficlent service for the people ln the area and the general publlc as a whole. SECTION 2. The Redevelopment Plan for the Downtown Redevelopment ProJect, 1S hereby lncorporated hereln by reference and made a part hereof as fully as Lf set out at length hereln. SECTION 3. The Redevelopment Plan hereby is approved and adopted and deslgnated the offlclal redevelopment plan for the Downtown Redevelopment Project. -2- - e SECTION 4. The City Counc~l after cons~derlng the Env1ronmental Impact Report, f1nds that the Project wlll not have any slgnlf1cant adverse 1mpact on the enVlronment and hereby certlfies and adopts sald Report as the report of the Councll. SECTION 5. The C1ty Council hereby flnds and deter- m1nes that: (1) The ProJect area is a bllghted area, the redevelopment of which 18 necessary to effectuate the public purposes declared 1n the Community Redevelopment Law of the State of Callforn1ai (2) The Redevelopment Plan wlll redevelop the ProJect area 1n conformlty wlth the Community Redevelop- ment Law of the State of Californla and 10 the interests of the publ1C peace, health and safety and welfare; (3) The adoptlon and carrYlng out of the Redevelopment Plan 1S economlcally sound and feaslble; (4) The Redevelopment Plan conforms to the General Plan of the C1ty of Santa Monica; (5) The carrying out of the Redevelopment Plan wll1 promote the publlc peace, health, safety and welfare of the Clty of Santa Monica and w1ll effectuate the purposes and pollc1es of the Community Redevelopment Law of the state of Californ1a. (6) The condemnat1on of real property, as prov1ded for 1n the Redevelopment Plan for the ProJect area, is necessary to the executlon of the Redevelopment Plan and adequate prOV1S1ons have been made for payment for property to be acqu1red as provided by law; -3- e e (7) The Agency has a feasible method and plan for the relocation of fam1lies and persons to be temporarily or permanently displaced from housing facilit1es 1n the Project area; (8) There w1II be provided in other areas not generally less des1rable 1n regard to public ut1l1tes and publlC and commercial facllitles and at rents or pr1ces wlthln the flnancial means of the families and persons dis- placed from the ProJect area, decent, safe, and sanitary dwellings equal in number to the number of and avallable to such dlsplaced famllles and persons and reasonably accesslble to thelr places of employment~ (9) The Redevelopment Plan for the ProJect area will afford a maxlmum opportunlty conslstent with the sound needs of the locality as a whole for the redevelopment of such area by private enterprlse; (10) In order to lmplement and facilitate the effectuat10n of the Redevelopment Plan hereby approved and adopted lt is found and determlned that certain official actlon must be taken by the C1ty Councll wlth reference, among other things, to changes ln 20n1ng, the vacating and removal of streets, and other puhllC ways, the locat1on and relocatlon of sewer and water malns and other publlC fac11lties, and other public action, and accordlngly the Clty Councll hereby: (a) Pledges 1ts cooperation 1n helping to carry out such Redevelopment Plan~ and (h) Requests the var10US offlcials, departments, boards and agencies of the City of Santa Monica hav1ng adm1nlstratlve responsiblllties ln the premises like- wise to cooperate to such end and to exercise thelr respective -4- e e functlons and powers ln a manner conslstent wlth said Redev- elopment Plani and (c) Stands ready to take appropriate actlon upon proposals and measures deslgned to effectuate the Redevelopment Plan. SECT10N 6. The City Council is satisfied permanent houslng facillties will be avallable wlthln three years from the tlme occupants of the ProJect area are dlsplaced and that pending the development of such facllities there wlll be avallable to such dlsplaced occupants adequate temporary houslng facilites at rents comparable to those ln the Clty of Santa Monica at the tlme of their displacement. SECTION 7. All written and oral objectlons to the Redevelopment Plan are hereby ovex~uled. SECTION 8. The Clty Clerk hereby is dlrected to send a certlfled copy of thlS ordinance to the Agency and the Agency hereby is vested wlth the responslblllty for carrYlng out the Redevelopment Plan for the Downtown Redev- elopment ProJect. SECTION 9. The City Clerk hereby is dlrected to record wlth the County Recorder of Los Angeles County a des- crlptlon of the land withln the Project area and a statement that proceedlngs for the redevelopment of the ProJect area have been lnstituted under the Californla Communlty Redev- elopment Law. The Agency hereby is directed to effectuate recordation ln compllance wlth the provislons of Sectlon 27295 of the Government Code to the extent applicable. SECTION 10. The Department of Building and Safety of the C1ty of Santa Monlca 15 hereby dlrected for a period of two years after the effective date of thlS ordinance to advise all appllcants for bUlldlng permlts wlthln the -5- e e Project area that the s~te for Wh1Ch a build~ng permit is sought for the construct~on of build1ngs or for other lm- provements 1S within a redevelopment proJect area. SECTION 11. The C1ty Clerk ~s dlrected, as promptly as practicable followlng the adopt~on of the Redevelopment Plan, to transm~t a copy of the description and statement recorded by the City pursuant to Sectlon 9 of th~s ordinance, and a map or plan showlng the boundar~es of the ProJect area to the Auditor and Tax Assessor of Los Angeles County, to the governing body of each of the taxing agencles WhlCh lev~es taxes upon any property ln the Project area, and to the State Board of Equal~zation. SECTION 12. The City Clerk shall cert1fy to the adopt~on of thlS ordinance and to ~ts approval by the City Counc~l and cause the same to be published once ln a news- paper with general c~rculation 1n the Clty of Santa Monica flfteen days after ~ts adoptlon. The ord~nance shall become effective after th~rty (30) days from 1ts adopt~on. The Mayor shall sign thlS ordinance.
