AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF SANTA MONICA AMENDING.
SECTION 4202A OF THE SAi"lTA MONICA
MUNICIPAL CODE PERTAINING TO NIGHTTIME
USE OF PARKS BY S~NTA MONICA ORGANIZATIONS.
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES
HEREBY ORDAIN AS FOLLOWS:
SECTION 1.
Section 4202A of the Santa Monica
Municipal Code is hereby amended to read as follows:
Section 4202A. Beaches, Parks, Playgrounds,
Sleeping or Loitering Prohibited. Exceptions. No person shall
sleep or loiter upon any public beach or in any public park or
public playground between the hours of midnight and five (5:00)
A.M. except as herein provided. A permit may be issued to any
organization having local or national headquarters in Santa Monica
by the Director of Recreation and Parks for camping, sleeping or
related events and activities conducted in or upon any public
park between the hours of midnight and five (5:00) A.M.
Such
permit may allow the use of tents or other temporary housing or
shelters which do not meet the requirements of Section 4202. No
such permit shall be issued pursuant to this section unless the
event or activities for which such permit is requested is sponsored
by a Santa Monica organization and a majority of the proposed
participants in the event are residents of the City of Santa
Monica. Any such permit which is issued shall specify the dates
for which it is issued and shall be valid only upon such specific
dates.
SECTION 2.
Any provision of the Santa Monica
Municipal Code, or appendices thereto inconsistent herewith,

to the extent of such inconsistencies and no further, are hereby
repealed or modified to that extent necessary to effect the
provisions of this ordinance.
SECTION 3.
If any section, subsection, sentence,
clause or phrase of this ordinance is for any reason held to be
invalid or unconstitutional by a decision of any court of competent
jurisdiction, such decision shall not affect the validity of the
remaining portions of the ordinance. The City Council hereby
declares that it would have passed this ordinance and each and
every section, subsection, sentence, clause or phrase not declared
invalid or unconstitutional without regard to whether any portion
of the ordinance would be subsequently declared invalid or
unconstitutional.
SECTION 4.
The Mayor shall sign and the City Clerk
shall attest to the passage of this ordinance. The City Clerk
shall cause the same to be published once in the official newspaper
,vi thin fifteen (15) days after its adoption. The ordinance shall
become effective after thirty (30) days from its adoption.
