AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF SANTA MONICA AMENDING PORTIONS
OF CHAPTER 3 OF ARTICLE VII OF THE SANTA
MONICA MUNICIPAL CODE,PERTAINING TO THE
PRICE OF PROPERTY AND SERVICES AT THE
WOODLAWN CEMETERY.
THE CITY COUNCIL OF THE CITY OF S&~TA MONICA DOES
ORDAIN AS FOLLOWS:
SECTION 1.
Chapter 3 of Article VII of the Santa Monica
Mun~c~pal Code (sections 7300, et seq.) ~s hereby amended to read
as follows:
Sectlon 7308. Price and Fee Schedule.
The pr~ce
for all property and services throughout the cemetery shall be
established through schedules to be flxed from time to t~me by
resolution of the Clty Council.
Section 7310. Payment. No burial plot shall be
regarded as sold, and no deed convey~ng a plot shall be dellvered
untll the amount due for the plot, perpetual care, and all other
,
charges are fully pa~d. No interment nor me~or~al shall be placed
in or upon any property WhlCh has not been fully paid for, except
by speclal consent of the Cemetery Superlntendent ~n writ~ng. In
the event that such consent ~s given, any lnterment or memorial
placed in or upon said plot shall be consldered as temporary. A
note or contract shall not be considered as payment. In case the
purchaser of sald plot shall fail to meet any payment wlthin thirty
(30) days after the same is demanded, the cemetery may re-enter
sald property and hold the sa~e as of its former estate. In such
case, the cemetery reserves and shall have the right at its dis-
cretlon to cremate lmmedlately, or any time thereafter, any body
contained ~n said plot,to remove any said body to a slngle grave

to be chosen by the cemetery, and shall have the right to remove
any memor~al that may have been pJaced in or upon said property.
Prepayment. Prepayment on the basis of the estab-
l~shment schedule wl1l be required of any person ordering work
done on account of a plot owner, elther lmproving or carlng for
sald plot.
Plot ~ must notlfy cemetery. It shall be the
duty of the plot owner to notify the cemetery of any change in
his or her post offlce address. Notice sent to a plot owner by
the cemetery shall be considered sufficient and proper legal notl-
flcat~on.
Arrea~e. No interment shall be made in any plot,
nor shall any work be done in connectlon with such plot, until the
purchaser thereof shall have pald all outstandlng obl~gations to
the Clty, or entered lnto a contract for such payment, without the
consent of the Cemetery Super~ntendent.
Saturday Interments. Saturday interments will be
performed only with the approval of the Cemetery Superintendent.
Section 7313. Burial Vaults. All ground lnter~ents
in the cemetery shall be ln vaults. Vaults may be furnlshed by the
owner of the burial plot, subject to the acceptance after lnspec-
tion by the Cemetery Superlntendent.
Section 7314. Interments. Not more than one (1) lnter-
ment shall be permltted in any grave, except when the owner's con-
sent ln wrlting has been flIed wlth the Cemetery Superintendent,
and sa~d Superlntendent may consent to the burlal in one (I) grave
of a mother and her infant child, or of a person and the crematlon
ashes of members of the family of said gerson, provlded such crema-
tlon ashes are placed in proper containers. provlded further, that

the Cemetery Superlntendent may permit two (2) bur~als ~n
one (I) grave whenever he deems it is proper, provided such request
has been made to the Superintendent and the cost of said lnterments
paid in advance. The first interment must be made with the bottom
of the grave three (3) feet lower than the present regulation
depth ~n sa~d cemetery.
No interment shall be permitted unless the deceased
was a res~dent of the City of Santa Mon~ca at the time of death,
or at sometime prior to his or her death had been a resident for
a period of five (5) years of the City of Santa Mon~ca, or unless
there ~s lnterred in th~s cemetery a relative by blood or marriage
of the deceased, or unless the deceased at the t~me of death was
a member of the armed forces on active duty.
The owners of plots may not allow ~nterments ~n the~r
said plots of bodles of persons other than members of the~r family,
except when said owners flle wlth the Cemetery Superlntendent writ-
ten declarations that no remuneration whatever has been or w~ll be
recelved for the privllege of such interment. The Cemetery Super~n-
tendent may refuse interment of any non-member of the fam~ly when-
ever he shall deem lt proper.
SECTION 2. Any provlsion of the Santa Monica Munic~pal
Code, or appendices thereto ~nconsistent herewlth, to the extent
of such inconsistencies and no further, are hereby repealed or
rnodif~ed to the extent necessary to effect the prov~sions of thlS
ordinance.
SECTION 3. If any section, subsection, sentence, clause
or phrase of thlS ordlnance ~s for any reason held to be lnval~d
or unconstitutional by a declsion of a court of competent juris-
d~ct~on, such decision shall not affect the validlty of the re-
main~ng portions of the ordinance. The City Councll hereby declares
that lt would have passed thlS ordinance and each and every sect~on,
subsect~on, sentence, clause or phrase not declared inval~d or

unconstLtutlonal without regard to whether any portion of the
ord~nance would be subsequently declared invalid or unconst~tu-
tional.
SECTION 4. The Mayor shall sign and the City Clerk shall
attest to the passage of this ordinance. The City Clerk shall
cause the same to be published once in the official newspaper
with~n fifteen (15) days after ~ts adoption, pursuant to Section
619 of the Santa Manica ~~unicipal Charter.

THE CITY OF SANTA MONICA AMENDING
SECTION 4202A OF THE SANTA MONICA
MUNICIPAL CODE PERTAINING TO NIGHTTIME
USE OF PARKS BY SANTA MONICA ORGANIZATIONS.
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES
HEREBY ORDAIN AS FOLLOWS:
SECTION 1.
Sect~on 4202A of the Santa Monica
Municipal Code is hereby amended to read as follows:
Section 4202A. Beaches, Parks, Playgrounds,
Sleeplng or Loiterln9 Prohibited. ExceFtions. No person shall
sleep or loiter upon any public beach or in any public park or
public playground between the hours of midn~ght and f~ve (5:00)
A.M. except as here~n prov~ded. A perffilt may be issued to any
organization having local or national headquarters in Santa Monica
by the Dlrector of Recreation and Parks for camping, sleeping or
related events and activit~es conducted in or upon any publ~c
park between the hours of mldnight and five (S:OO) A.M.
Such
permit may allow the use of tents or other temporary housing or
shelters wh~ch do not meet the requirements of Sect~on 4202. No
such permit shall be issued pursuant to thlS sectlon unless the
event or activitles for WhlCh such permit lS requested lS sponsored
by a Santa Mon~ca organization and a majority of the proposed
part~cipants in the event are resldents of the City of Santa
Monica. Any such permit which is issued shall spec~fy the dates
for which it is issued and shall be valld only upon such specific
dates.
SECTION 2.
