'" ~ --::'".& ..-. .wr _'~ CA RWS1S:jst e .':J';_ l.,.~ 6-12-75 ORDINANCE NO. 100b (CCS) (Clty Counc~l Series) AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA AMENDING SECTION 9115Bl OF THE SANTA MONICA MUNICIPAL CODE, PERTAINING TO BUILDING HEIGHT IN THE C-2 DISTRICT. THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. Section 91l5B1 of the Santa Mon~ca Municipal Code is hereby amended to read as follows: Section 9115B. Prope~ty Development Standards. The followlng property development standards shall apply to all land and structures in the "C-2" dlstrlct. 1. BUlldin9 Height. Any build~ng or structure erected ~n this distrlct shall not exceed thirty- f~ve (3S) feet ~n height; provlded that, an additional ten (10) feet may be allowed for roof top mechanical equlprnent only. SECTION 2. Any provls~on of the Santa Mon~ca Munlclpal Code, or appendlces thereto inconslstent herewlth, to the extent of such lnconsistenCles and no further, are hereby repealed or modified to that extent necessary to effect the provislons of th~s ordinance. SECTION 3. If any section subsection, sentence, clause or phrase of thlS ordinance ~s for any reason held to be invalld or unconstltutlonal by a decision of any court of competent jur~sd~ction, such decision shall not affect the validity of the rema~ning portlons of the ordlnance. The Clty Council hereby declares that lt would have passed this ordinance and each and every sect~on, subsection, sentence, clause or phrase not declared inval~d or unconstltutional wlthout regard to whether any port~on of the ordinance would be subsequently -1- ~ ... "\ e e declared lnvalid or unconst~tutional. SECTION 4. The Mayor shall sign and the City Clerk shall attest to the passage of thlS ordlnance. The Clty Clerk shall cause the same to be publ~shed once in the offlclal newspaper wlthln fifteen (lS) days after lts adoption. Background The present bUllding belght Ilmit permitted in the C2 Nelgbborbood Commerclal Dlstrict is 45t which generally represents a 4 story structure. As a result of Section 9126D however, this llmit is walved provided that the result~ng buildlP~ does not exceed the bulk nor floor area whicb could be constructed within the 45' l~mit. For instance, on a building site of 100' x lOa' a 9 story building 90' blgh could be built because it would be no greater in floor area or bulk than a 45' high bUllding coverlng the wbole lOa' x lOa'. The C2 Neighborhood Commerclal District provldes retall and commerclal serVlce faclllties for resldential nelghborhoods. The princlpal C2 areas In the City are sltuated on Montana Avenue, Ocean Park Boulevard, portions of Pico Boulevard and 26th Street between San Vicente and Georglna. A large proportlon of these areas abut or back up to elther Rl or R2 areas. - 1 - e e The City Planning Commission has concluded that there is no necesslty for commercial structures in excess of 2 to 3 stories In these areas and bas recommended that the beight limlt be re- duced to 35' and the provlsions for gOlng higher on tbe basis of less lot coverage elimlnated. The effect of the proposed amend- IDent would be to limit building heights to a maximum of 351 regard- less of number of stories or lofts or shape of roof wlth the added provision that elevator penthouses, smoke towers or other structures for the housing of mechanical equlpment may be located on the roof but not over 45'. A survey of existing bUlldlngs in the C2 Dis- trict indicates that only one, at 26th and Georgina, approaches the 45' limit reaching 431 at one point. The enactment of the proposed amendment should have little 1f any economic impact in light of the failure of existing devel- opm~nt to avall 1tself of the 45' opportunity and the fact that 351 will allow up to 3 stories if requlred. Recommendat1on In view of the Planning Comm1ssion's analysis and conslderatlon includ1v~ a Fubllc HearlP~ of whlch all 02 property owners were notified and the absence of any slgnlflcant number of structures exceedlng the Commlssion's proposal, It is respectfully recommended that the matter be favorably acted upon-and the City Attorney re- quested to draft the necessary ord1nance for Clty Counc1l enactment.
