ORDINANCE NO. 1005 (CCS)

AN ORDINM~CE OF THE CIT~ COUNCIL OF
THE CITY OF SANTA MONICA AlfENDING
SECTIONS 4241 AND 4242 OF THE SANTA
MONICA MUNICIPAL CODE, PERTAINING TO
PARADE ROUTES AND DECLARING THE
PRESENCE OF AN EMERGENCY.
THE CITY COUNCIL OF THL CITY OF SANTA MONICA DOES
ORDAIN AS FOLLOWS:
SECTION 1.
Sectlon 4241 of the Santa Monlca
Munlcipal Code 15 hereby amended and shall read as follows:
Sectlon 4241.
Parades.
No person shall hold,
manage, conduct, carryon, or participate ln, any parade, march,
or processlon of any kind or any other sim~lar actlv~ty or beat
or play any drum, triangle, tambourlne, or any w~nd or strlng
instrument upon any street or alley ln the City without flrst
hav~ng appl1ed for and obta~ned a permlt therefore from the
Chief of Pol~ce with the approval of the C~ty Manager as provlded
1n this Chapter.
Ocean Avenue, between the northwest
City limits and Colorado Avenue, shall be the Clty'S offlclal
parade route, and the Chief of Pollce shall issue a permlt for
a parade, march, or procession on any other street withln the
Clty only after the route for such parade, ~arch, or processlon
is author~zed by resolution of the City Council.
SECTION 2.
Sectlon 4242 of the Santa Monica
Munlcipal Code is hereby amended and shall read as follows:
Section 4242. Appllcat~on For Permlt. Any
person desiring to do any of the acts specified in Sectlon 4241
hereof shall fl1e an application wlth the C~lef of Pollce upon
a form to be supplled by the Clty wlthout charge to the appl1cant

settlng forth the followlng ~nforrnatlon ~n regard to the proposed
event:
(1) The name and address of the
appl~cant; and,
(2) The purpose; and,
(3) The date and time; and,
(4) The part of Ocean Avenue to be
ut~lized along w~th any requlred formatlon or d~sbandlng areas
or the streets, or portlons thereof, withln the City, other than
Ocean Avenue, to be utlllzed, along wlth any requ~red formation
or d15band~ng areas.
SECTION 3. It 1S urgent that th1S ord1nance take
effect upon ~ts adoptlon so as to provlde the ava~lab~llt7 of
the alternate parade route procedure for the holiday weekend
precedlng September 1, 1975.
SECTION 4. Th~s ord~nance ~s declared to be an
emergency measure adopted pursuant to the prOV1S1ons of Sectlon
615 of the Charter of the City of Santa f10nica and ~s necessary
for preserVlng the publlC peace, health, or safety, and the
reasons for lts urgency of adoptlon are set forth above.
SECTION 5. Any prov~slon of the Santa Monlca
Municlpal Code, or append1ces thereto lnconslstent herewlth, to
the extent of such inconslstencies and no further, are hereby
repealed or modlfled to that extent necessary to effect the
provlslons of thlS ordlnance.
SECTION 6. If any sectlon, subsect~on, sentence,
clause or phrase of thlS ordlnance ~s for any reason held to be
lnva1~d or unconst1tutlonal by a dec1510n of any court of competent
Jurlsdlctlon, such decision shall not affect the valldlty of the
remalnlng portlons of the ordlnance. The City Councll hereby
declares that it would have passed thlS ordlnance and each and
