A RESOLUTION OF THE CITY OF SANTA MONICA
DESIGNATING SMOKING AREAS ON THE SANTA MONICA PIER
WHEREAS, on April 27, 2004, the City Council adopted an ordinance amending Chapter
4.44 of the Municipal Code prohibiting smoking in waiting areas for public services, on
the Santa Monica Beach, on the Santa Monica Pier, except in designated smoking areas,
and within 20 feet of entrances and exits to public buildings; and
WHEREAS, in order to minimize the potential adverse impact of smoking on visitors, the
Santa Monica Pier and the environment, certain areas where smoking shall be permitted
have been identified on the public deck of the Santa Monica Pier; and
WHEREAS, while minimizing the adverse impacts of smoking, the City Council also
wishes to preserve the economic viability ofthe Pier; and
WHEREAS, allowing smoking in portions ofthe outdoor dining areas of Pier restaurants
will ensure that those restaurants are not placed at a disadvantage relative to other
restaurants in the City; and
WHEREAS, allowing actors to smoke on the Pier as part of a film will ensure that the
Pier remains a popular filming location; and
WHEREAS, allowing smoking at Pacific Park during special events closed to the public
will preserve the Pier's marketability as a private event site,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:
Section 1. Smoking is prohibited on all areas of the Santa Monic'). Pier except in
designated smoking areas as approved by the City Council. .
Section 2. Designated smoking areas on the public deck shall be restricted to no more
than a 5'x15' area, shall be made fire resistant, shall be supplied with ashtrays for

disposal of smoking material and shall be identifiable as designated smoking areas by
means of signs and painted markings.
Section 3. The following areas on the public deck, identified below, and shown on
the attached Santa Monica Pier Designated Smoking Area Map as Exhibit 1, shall be
designated as smoking areas.
Area #1. West Gazebo
Area #2. South Rail
Area #4. Fire Lane to the Rear of Pacific Park
Area #5. Fire Lane West of Pacific Park Restrooms
Area #6. South Lower Fishing Deck
Area #7. Rear of West Public Restrooms
Area #8. West Lower Fishing Deck
Area #9. West Upper Deck
Section 4. Restaurants on the Pier may designate smoking areas on a portion of, or on
all of their outdoor dining patios. Where operators allow smoking in outdoor dining
patios, areas must be made fire resistant and ashtrays must be provided.
Section 5. A 'special use' exemption will be available for private events within
Pacific Park, and for actors smoking during filming as part oftheir roles in the film,
subject to approval by the City's Fire Marshal.
Section 6. The City Clerk shall certify to the adoption ofthis Resolution, and
thenceforth and thereafter the same shall be in full force and effect.
