R-9767 RESOLUTION NUMBER976z(CCS) (City Council Series) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA RELEASING CITY OF SANTA MONICA FUNDS AVAILABLE UNDER THE JUVENILE ACCOUNTABILITY INCENTIVE BLOCK GRANT (JAIBG) PROGRAM TO THE COUNTY OF LOS ANGELES FOR THE PURPOSE OF HIRING A HEARING OFFICER UNDER THE JUVENILE OFFENDER INTERVENTION NETWORK (JOIN) PROGRAM FOR EARLY INTERVENTION WITH MINORS ARRESTED FOR NON-VIOLENT FIRST TIME OFFENSES WHEREAS, grant funds are available for Fiscal Year 2002-2003 from the Juvenile Accountability Incentive Block Grant (JAIBG) Program for the purpose of coordinating the Juvenile Offender Intervention Network (JOIN) program in the City; and WHEREAS, this purpose can best be achieved by the City releasing its grant funds under JAIBG to the County of Los Angeles to hire a hearing officer for early intervention with minors arrested for non-violent first time offenses. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1. The City of Santa Monica waives its right to receive its entire direct sub grant award and authorizes the funds to be expended by the County of Los Angeles on condition that the funds be expended for the hiring of a hearing officer who will administer the JOIN Program in Santa Monica. 4 SECTION 2. The City Council authorizes the City Manager, or her designee, to negotiate and enter into an agreement with the County of Los Angeles for the hiring of a hearing officer to administer the JOIN Program in Santa Monica in an amount not to exceed the amount of the grant funds which were available to the City under the Juvenile Accountability Incentive Block Grant. SECTION 3. The City of Santa Monica acknowledges and resolves that any liability arising out of the performance of these JAIBG Program funds, including civil court actions for damages, shall be the responsibility of the County of Los Angeles ("grant recipient"). The State of California, OCJP and the City of Santa Monica disclaim responsibility for any such liability. SECTION 4. The grant funds received hereunder shall not be used to supplant expenditures controlled by the City of Santa Monica. SECTION 5. The City Clerk shall certify to the adoption of this Resolution, and henceforth and thereafter the same shall be in full force and effect.
