excepted from said vacation an easement, the extent of which
spans the entire width and length of said street, for the purpose
of constructing, maintaining, operating, replacing, removing, and
renewing all sanitary sewers, water mains, and other public
utilities and appurtenant structures and general public access:
and
WHEREAS, the city Council of the City of Santa Monica,
concurrently with its vacation of said portion of Twenty-Fourth
Street between Santa Monica Boulevard and Santa Monica Place

south, denied an appeal and affirmed the approval by the Planning
Commission of the city of Santa Monica of Application for
Development Review Number 369, subject to certain conditions of
approval stated therein; and
WHEREAS, the improvements authorized by the approval of
Application for Development Review Number 369 shall extend on,
above, and under the southwesterly nineteen (19) feet of that
portion of Twenty-Fourth Street between Santa Monica Boulevard
and Santa Monica Place South; and
WHEREAS, only the northeasterly forty-one (41) feet of that
portion of Twenty-Fourth Street between Santa Monica Boulevard
and Santa Monica Place South is necessary and convenient for
constructing, maintaining, operating, replacing, removing, and
renewing all sanitary sewers, water mains, and other public
utilities and appurtenant structures and general public access;
and
WHEREAS, the City Council of the City of Santa Monica, in
vacating said portion of Twenty-Fourth street between Santa
Monica Boulevard and Santa Monica Place South, inadvertently
reserved and excepted from said vacation an easement which spans
the entire width and length of said street, rather than just the
northeasterly forty-one (41) feet of said street; and
WHEREAS, the City Council of the city of Santa Monica
hereby intends to correct the dimensions of said reservation and
exception to comport with its action in affirming the approval of
Application for Development Review Number 369 by the Planning
commission of the city of Santa Monica,

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES RESOLVE AS FOLLOWS:
SECTION 1. The City Council of the City of Santa Monica
hereby repeals Resolution Number 7581 (CCS) in its entirety, as
adopted on March 15, 1988, and recorded in the Los Angeles County
Recorder's Office on March 31, 1988, as Document No. 88-432778.
SECTION 2. The City Council of the City of Santa Monica,
having heard the evidence offered in relation to the proposed
vacation of a portion of Twenty-Fourth Street, 60 feet in width,
between Santa Monica Boulevard and Santa Monica Place South
described as follows: the northeasterly boundary of which is the
southwesterly boundary of Lot 3 and the 20 foot extension of said
southwesterly boundary to the southeast, all as shown in Tract
No. 4208 in the City of Santa Monica, county of Los Angeles,
state of California, as per Map recorded in Book 45, Page 8, of
Maps in the Official Records of the county Recorder of said
County, hereby finds from all of the evidence submitted that the
portion of the street referred to and proposed to be vacated by
Resolution No. 7528 (CCS), and formerly vacated by Resolution
Number 7581 (CCS), is and remains unnecessary for present or
prospective street purposes and is and remains consistent with
the General Plan of the City of Santa Monica. Map Number 4425
entitled "Map Showing Portion of Twenty-Fourth Street between
Santa Monica Boulevard and Santa Monica Place South to be Vacated
Under the provisions of the Street Vacation Act of 1941," dated
November 17, 1988, is hereby attached and incorporated into this
Resolution.

SECTION 3. The City Council of the City of Santa Monica,
in vacating said portion of Twenty-Fourth street between Santa
Monica Boulevard and Santa Monica Place South intends to reserve
and except from said vacation an easement, the extent of which
spans the northeasterly forty-one (41) feet in width and the
entire length of said street for the purpose of constructing,
maintaining, operating, replacing, removing, and renewing all
sanitary sewers, water mains, and other public utilities and
appurtenant structures and general public access. The City
Council of the City of Santa Monica finds that the public
convenience and necessity require such reservation.
SECTION 4. Oscar Katz, as Trustee of the Oscar Katz Trust,
in consideration of the aforementioned vacation has and will
dedicate to the City of Santa Monica a twelve (12) foot wide
strip of land for the creation of a right-hand turn lane
described as follows: a strip of land, 12.00 feet in width, the
southwesterly boundary of which is Lot 5 of Schader's Addition,
as shown in Book 6, Page 67, of Maps, in the City of Santa
Monica, County of Los Angeles, State of California, on record in
the office of the County Recorder of said county.
SECTION 5. Oscar Katz, Trustee of the Oscar Katz Trust, as
additional consideration for the aforementioned vacation will
dedicate to the City of Santa Monica an easement over a portion
of Lot 5 of Block 2 in the Schader Addition for the purpose of
constructing, maintaining, operating, and renewing a handicap
access sidewalk ramp at the land described as follows:
Commencing at the northwest corner of said Lot 5; then north 450~'

15' east along the northwesterly line of said Lot 5, distant
12.00 feet to the true point of beginning; thence north 450 IS'
east along the northwesterly line of said Lot 5, distant 10.00
feet; thence south 440 IS' east 1.00 footi thence south 450 14'
west 5.00 feet; then south 00 15' west 2.83 feet; then south 440
45' east 5.00 feet: thence south 450 IS' west 3.00 feet to a line
parallel with and 12.00 feet northeasterly, measured at right
angles from the southwesterly line of said Lot 5: thence north
440 45' west along said parallel line 8.00 feet to the true point
of beginning.
SECTION 6. Twenty-Fourth street between Santa Monica
Boulevard and Santa Monica Place South, as shown on the City of
Santa Monica Drawing Number 4425, dated November 17, 1988, is
hereby vacated.
SECTION 7. Pursuant to Streets and Highways Code Section
8325, the City Clerk shall also cause a copy of this Resolution
to be recorded in the office of the County Recorder of the County
of Los Angeles. Upon such recording, the vacation shall be
complete.
SECTION 8. Resolution Number 7581 (CCS) is hereby repealed
and shall be of no further force and effect.
SECTION 9. The City Clerk shall certify to the adoption of
this Resolution, and thenceforth and thereafter the same shall be
in full force and effect.

CERTIFICATION
This is to certify that the interest in real property
conveyed by the attached Easement dated November 30, 1988, from
Oscar Katz, Trustee of the Oscar Katz Trust, to the City of Santa
Monica, a California charter city, for a handicapped access
sidewalk ramp is hereby accepted by order of the Santa Monica
City Council as set forth in City of Santa Monica Resolution No.
7719 (CCS) dated November 22, 1988, and the Grantee consents to
recordation of said Easement by the Los Angeles County Recorder's
Office.
