A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF SANTA MONICA DECLARING
ITS INTENTION TO GRANT A FRANCHISE
TO SOUTHERN CALIFORNIA GAS COMPANY
AND FIXING THE TIME fu~D PLACE FOR A
HEARING OF OBJECTIONS TO THE GRANTING
THEREOF.
WHEREAS, the City of Santa Monica Granted a franchise
for the transmission and distribution of natural gas in the
City of Santa Monica to Southern Counties Gas Company of Calif-
ornia, a predecessor of Southern California Gas Company on or
about May 3, 1937; and,
WHEREAS, said franchise has expired; and,
WHEREAS, it is necessary to provide for the transmission
and distribution of natural gas and for the laying of pipes
therefor within the City of Santa Monica; and,
WHEREAS, the City Council of the City of Santa Monica
has received from Southern California Gas Company, a corporation
organized and existing under and by virtue of the laws of the
State of California, and engaged as a public utility corporation
in transmitting and distributing gas for all purposes to consumers
and various municipalities and communities in the State of
California, inclUding the City of Santa Monica, an application,
under and pursuant to the provisions of Division 3, Chapter 2 of
the Public Utilities Code of the State of California and the City
Charter of the City of Santa Monica, for a franchise, which said
application states, in compliance with the provisions of Section
6231 of the Public Utilities Code and Section 1600 et seq. of the
City Charter of the City of Santa Monica, that the purpose for
which the franchise therein applied for is desired is to lay and
use pipes and appurtenances for transmitting and distributing gas

for any and all purposes under, along, across or upon the public
streets, ways, alleys, and places as the same may now or may
hereafter exist within the City of Santa rtonica; and that the
term for which the franchise therein applied for is indeterminate,
as defined in Section 6264 of the Public Utilities Code and
Section 1602 of the City Charter of the City of Santa Monica; and,
WHEREAS, said application further states that the
applicant, if granted the franchise therein applied for, will
pay to the City of Santa Monica during the life of such franchise,
two (2%) percent of the gross annual receipts of applicant arising
from the use, operation or possession of said franchise; provided,
however, that such payment shall in no event be less than one (1%)
percent of the gross annual receipts of applicant derived from
the sale of gas within the limits of the City of Santa Monica
under said gas franchise.
NOW, THEREFORE, the City Council of the City of Santa
Monica does resolve as follows:
SECTION 1. That the City Council of the City of
Santa Monica, pursuant to the provisions of Section 6205 of the
Public Utilities Code of the State of California, and Section 1601
of the City Charter of the City of Santa Monica, does hereby
declare its intention to grant a franchise to lay and use pipes
and appurtenances for transmitting and distributing gas for any
and all purposes under, along, across or upon the public streets,
ways, alleys, and places in the City of Santa Monica to the
Southern California Gas Company.
SECTION 2. That said franchise is proposed to be
granted for an indeterminate term, pursuant to Section 6264 of
the Public Utilities Code of the State of California and Section
1602 of the City Charter of the City of Santa Monica.
SECTION 3. That July 12,1977, at 7:30 o'clock p.m.,
at the Santa Monica City Council Chambers is the place and time

hereby fixed for a hearing on said proposed granted franchise
whereat any persons having an interest therein or any objection
to the granting thereof may appear before the City Council and
be heard thereon (the time so fixed for such hearing being not
less than twenty (20) nor more than sixty (60) days after the
date of the passage of this Resolution) .
SECTION 4.
That the application for said franchise
states, and Southern California Gas Company, its successors and
assigns will, if the franchise is granted, during the life of
said franchise, pay to the City of Santa Monica, two (2%) percent
of the gross annual receipts of Southern California Gas Company
arising from the use, operation or possession of said franchise;
provided, however, that such payment shall in no event be less
than one (1%) percent of the gross annual receipts of Southern
California Gas Company, its successors and assigns, derived from
the sale of gas within the limits of the City of Santa Monica
under said gas franchise. Further, said percentage will be paid
annually from the date of the granting of said franchise, and in
the event that such payment shall not be made said franchise will
be forfeited.
SECTION 5.
The City Clerk is hereby directed to
publish this resolution at least once within fifteen (15) days
of the passage hereof in the official newspaper, to wit: the
Santa Monica Evening Outlook, pursuant to Section 1601 of the
Santa Monica City Charter.
SEC'l'ION 6.
The City Clerk shall certify to the
adoption of this resolution, and thenceforth and thereafter the
same shall be in full force and effect.
