R-10124 City Council Meeting: April 11, 2006 RESOLUTION NO. 10124 (CCS) (City Council Series) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA ADOPTING THE NEGATIVE DECLARATION FOR THE TRANSPORTATION PRESERVATION DISTRICT ZONING ORDINANCE AMENDMENT WHEREAS, a Notice of Intent to Adopt an Initial Study and Proposed Negative Declaration for the Transportation Preservation District Zoning Ordinance Amendment was published on January 5, 2006, in compliance with the California Environmental Quality Act (CEQA) and the City of Santa Monica CEQA Guidelines; and, WHEREAS, the Initial Study and Proposed Draft Negative Declaration was made available for public comment for 20-days beginning on January 9, 2006 to January 30, 2006. WHEREAS, on March 1, 2006, the Planning Commission, reviewed and recommended that the City Council adopt the Proposed Negative Declaration. WHEREAS, on April 11, 2006 the City Council, as Lead City Agency, has reviewed and considered the Negative Declaration in full compliance with State and City CEQA Guidelines. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES HEREBY RESOLVE AS FOLLOWS: 1 SECTION 1. The City Council finds that the Initial Study, which analyzed the issue areas of geology/soils, air quality, hydrology and water quality, biological resources, noise, shadows, hazards and hazardous materials, population/housing, land use and planning, transportation/traffic, utilities/service systems, public services, recreation, cultural resources, aesthetics, construction effects, economic and social impacts, agricultural resources, mineral resources and neighborhood effects, concluded that amending the City's Zoning Ordinance to designate the Exposition rail right-at-way as a Transportation Preservation District would have no significant environmental impacts. SECTION 2. The City Council has reviewed and considered the Initial Study and Negative Declaration, together with comments received during the public review process, prior to acting on the project. SECTION 3. The City Council finds, based on the whole record before it, including the Initial Study and Negative Declaration and comments received, that there is no substantial evidence that the Project will have a significant effect on the environment, and that the Negative Declaration reflects the City's independent judgment and analysis. Therefore, the City Council hereby approves the Negative Declaration. SECTION 4. Consistent with Public Resources Code Section 21081.6 (a) (2), the documents which constitute the record of proceedings for approving this project are located in the Planning and Community Development Department, 1685 Main Street, Room 212, Santa Monica, California. The custodian of these records is Ellen Gelbard, Deputy Director, of the Planning and Community Development Department. 2 SECTION 5.
