R-10122 City Council Meeting 3-28-06 Santa Monica, California RESOLUTION NO.1 0122 (CCS) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA AMENDING THE GENERAL PLAN LAND USE ELEMENT POLICIES 1.2.2 AND 1.2.3 TO ALLOW PARKING STRUCTURES FOR AUTOMOBILE DEALERSHIPS ON PARCELS DESIGNATED FOR LOW AND MEDIUM DENSITY HOUSING USE THAT ARE CURRENTLY ASSOCIATED WITH AN AUTOMOBILE DEALERSHIP WHEREAS, the Land Use and Circulation Element of the General Plan prohibits development of above-ground commercial parking structures on parcels designated for Low and Medium Density Housing; and WHEREAS, many of Santa Monica's automobile dealerships have a long established practice of using residential properties in Low and Medium Density Housing Districts in conjunction with their business operations; and WHEREAS, the City Council has determined that limited development of parking structures on those properties would be beneficial in terms of business retention, economic vitality, and reducing impacts from automobile dealership operations on the adjacent residential properties; and WHEREAS, the City Council directed staff to return with a proposed interim ordinance which authorized this limited development after conducting the necessary environmental review; and 1 WHEREAS, in 2005, the City began preparing an Environmental Impact Report in compliance with the California Environmental Quality Act which assessed the proposed interim ordinance and land use element amendment; and WHEREAS, a Notice of Preparation of an Environmental Impact Report was issued in February 2005; and WHEREAS, a Notice of Completion of a Draft Environmental Impact Report was published in May 2005; and WHEREAS, the Draft Environmental Impact Report was circulated for a 45-day period which ended on June 27, 2005; and WHEREAS, the Planning Commission adopted a resolution of intention to amend the Land Use Element of the General Plan on July 6,2005; and WHEREAS, on July 20, 2005, at a public hearing, the Planning Commission reviewed and recommended approval of the Final Environmental Impact Report; and WHEREAS, at this same public hearing, the Planning Commission reviewed and recommended approval of the proposed General Plan Amendment with certain modifications; and WHEREAS, the Council reviewed and certified a Final Environmental Impact Report for the project and adopted a Statement of Overriding Considerations on March 28, 2006; and WHEREAS, the Council reviewed the proposed General Plan Amendment at a public hearing on October 25, 2005 and March 28, 2006, and WHEREAS, prior to adoption of an Interim Ordinance, the City Council must find that the Interim Ordinance is consistent with the General Plan; and WHEREAS, amendment of the Land Use Element of the General Plan is necessary to ensure that the proposed project complies with the General Plan, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. Pursuant to the Santa Monica Municipal Code Section 9.04.20.18.100, the City Council hereby adopts the amendment to the Land Use Element of the General Plan contained in Exhibit 1. SECTION 2. The City Clerk shall certify to the adoption of this Resolution, and thenceforth and thereafter the same shall be in full force and effect. Maria M. Stewa 4 EXHIBIT 1 LAND USE ELEMENT AMENDMENT 1.2.2. When redeveloped, surface parking lots that are zoned residential adjacent to highway commercial corridors should be reserved for residential use or public open space on the surface (use for underground parking is acceptable). This policy shall not apply to lots zoned "A: Off- street Parking District or lots zoned residential if as of September 28, 2004, the residentially zoned lots were legally used in conjunction with an automobile dealership on an adjacent lot and if the automobile dealership uses have not subsequently been abandoned. Instead, Policy 1.2.3 shall apply. 1.2.3 Parking structures and underground parking shall be permitted with site review on land zoned "A" Off-street Parking District and on lots zoned residential if as of September 28, 2004, the residentially zoned lots were legally used in conjunction with an automobile dealership on an adjacent lot and if the automobile dealership uses have not subsequently been abandoned. These residentially zoned lots may only be redeveloped with parking structures and underground parking if this parking is used exclusively for automobile dealership off-street parking and inventory storage. In addition, automobile dealership parking and inventory storage may be allowed on surface lots with appropriate screening. Structures shall generally conform to the height, bulk, setback and landscape standards for the adjacent residential district except as is necessary to accommodate the specific structural and design requirements of parking structures. Such structures shall only be permitted if the facility will not adversely impact the adjacent residential neighborhood. This policy shall not apply to "A" zoned lots adjacent to neighborhood commercial zones except for the Wilshire Boulevard neighborhood commercial overlay zone.
