R-10120 Council Mtg: 03-28-06 Santa Monica, California RESOLUTION NUMBER 10120 (CCS) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA CERTIFYING THE FINAL PROGRAM ENVIRONMENTAL IMPACT REPORT FOR A PROPOSED GENERAL PLAN AMENDMENT MODIFYING POLICIES PERTAINING TO LOW AND MEDIUM DENSITY HOUSING DISTRICTS AND INTERIM ORDINANCE MODIFYING AUTOMOBILE DEALERSHIP STANDARDS IN VARIOUS ZONING DISTRICTS IN THE CITY WHEREAS, a Notice of Preparation of an Environmental Impact Report was issued in February 2005; and WHEREAS, a Notice of Completion of a Draft Environmental Impact Report was published in May 2005 in compliance with the California Environmental Quality Act and the City of Santa Monica CEQA Guidelines; and WHEREAS, the Draft Environmental Impact Report was circulated for a 45-day pe,riod which ended on June 27, 2005; and WHEREAS, on July 6, 2005, the Final Environmental Impact Report was published; and WHEREAS, on July, 20, 2005, the Planning Commission reviewed and recommended approval of the Final Environmental Impact Report; and WHEREAS, on October 25, 2005, and March 28, 2006, the Council, as Lead City Agency, reviewed and considered the contents of the Final EIR in its decision-making process, 1 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The Council has reviewed and considered the information contained in the Final Environmental Impact Report on the proposed General Plan Amendment and Interim Ordinance modifying automobile dealership regulations in the City prior to acting on the project. SECTION 2. The Council certifies that the Final EIR for the project was presented to the Planning Commission and Council, that the Final EIR for the project was completed in full compliance with State law and City CEQA Guidelines, that there was adequate public review of the Draft Environmental Impact Report, that it has considered all comments on the Draft Environmental Impact Report and responses to comments, that the Final Environmental Impact Report adequately discusses all significant environmental issues, that the Final Environmental Impact Report reflects the independent judgement and analysis of the City, and that the Council has reviewed and considered the information contained in the Final Environmental Impact Report in its decision-making process prior to acting on the project. 2 ",~ J>,O n.li t '->J SECTION 3. The City Clerk shall certify to the adoption of this Resolution, and thenceforth and thereafter the same shall be in full force and effect.
