R-10109 Council Meeting: February 14, 2006 Santa Monica, California RESOLUTION NO. 10109 (CCS) A Resolution of the City Council of the City of Santa Monica Authorizing the City Manager to Enter Into an Agreement with the State of California for Funding From the Urban Forestry Grant Program As Provided Through State Proposition 12, Green Trees for the Golden State WHEREAS, the Governor of the State of California in cooperation with the California State Legislature has enacted The Safe Neighborhood Parks, Clean Water, Clean Air and Coastal Protection Act of 2000, (the Villaraigosa - Keeley Act) Green Trees for the Golden State:, which provides funds to the State of California and its political subdivisions for urban forestry program s; and WHEREAS, the State Department of Forestry and Fire Protection has been delegated the responsibility for the administration of the program within the State, setting up necessary procedures governing application by local agencies and non-profit organizations under the program; and WHEREAS, said procedures established by the State Department of Forestry and Fire Protection require the applicant to certify by resolution the acceptance of Grant funding in the amount of $126,866.52; and 1 WHEREAS, the applicant will enter into a grant agreement with the State of California for the planting and establishment of 365 trees throughout the City of Santa Monica, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The City Manager is hereby authorized to enter into an agreement with the State of California for the "Green Trees for the Golden State" tree planting grant program funds. SECTION 2. The City Council certifies that the City of Santa Monica has or will have sufficient funds to operate and maintain the project after the establishment period and that funds under its jurisdiction are available to begin the project. SECTION 3. The City Council certifies that the City will expend the grant funds prior to December 31,2008. SECTION 4. The City Council appoints the City Manager as agent of the City of Santa Monica to conduct all negotiations, execute and s,ubmit all documents including, but not limited to applications, agreements, amendments, payment requests and so on, which may be necessary for the completion of the aforementioned project. 2 SECTION 5. The City Clerk shall certify to the adoption of this Resolution, and thenceforth the same shall be in full force and effect.
