A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA
ESTABLISHING LICENSE CHARGES FOR OUTDOOR DINING
WHEREAS, Santa Monica Municipal Code Section 9.04.12.120 allows outdoor
dining on the public right of way as a way to encourage public activity in commercial
districts and to enhance economic viability of restaurants; and
WHEREAS, Santa Monica Municipal Code Section 2.72.010 authorizes the
imposition of charges for private use of public property; and
WHEREAS, Santa Monica Municipal Code Section 2,72.020 authorizes setting
such charges by resolution; and
WHEREAS, the following charges reflect fair market value;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:

SECTION 1: The following charges for outdoor dining are hereby established, effective
July 1, 2005:

Bayside District:
Outside Bayside District:
Montana Avenue
Santa Monica Boulevard
Wilshire Boulevard
Ocean Avenue
Main Street
Pico Boulevard
Ocean Park Boulevard
Any Other Street

SECTION 2: These charges shall be increased by the Consumer Price Index effective
January 1 of each year.
SECTION 3: The City Clerk shall certify to the adoption of this Resolution, and the
same shall be in full force and effect.
