A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA
AUTHORIZING THE MAYOR TO SUBMIT ON BEHALF OF THE CITY
COUNCIL A LETTER OF SUPPORT FOR AB1612, CIGARETTE POLLUTION
AND LITTER PREVENTION ACT OF 2005
WHEREAS, Santa Monica Bay is a treasured local, state and national resource
that was nominated and accepted by Congress for inclusion in the Clean Water Act's
National Estuary Program in 1988; and
WHEREAS, the City of Santa Monica has many drainage basins that drain urban
runoff into the Santa Monica Bay, carrying with this flow many pollutants of concern that
have negative impacts on natural resources; and
WHEREAS, the State of California has allocated considerable funding, vis-e.-vis
Propositions 12, 13, 40 and 50, for grants to assist local governments for urban runoff
pollution control from designated sites for enhancement, restoration and protection of
estuarine and coastal resources, and wildlife habitat; and
WHEREAS, such grants while providing badly needed funding to carry out
abatement activities, do not approach sufficient levels to abate some pollutants, such as
cigarette butts; and
WHEREAS, California has some four million smokers who annually consume an
estimated 1.2 billion packs of cigarettes or approximately 22 billion cigarettes, and litter

from these cigarettes pose a significant source of water pollution and growing cost to
taxpayers, public health and the environment; and
WHEREAS, the Trash Total Maximum Daily Load (TMDL) regulations impose
additional costly requirements upon local agencies to take steps to reduce urban runoff
pollution, including cigarette butts, and local agencies do not have the funds necessary
to fully comply with this TMDL; and
WHEREAS, the City supports efforts to develop and provide additional funds for
litter control and compliance with TMDLs,
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES HEREBY RESOLVES AS FOLLOWS:
SECTION 1. The City Council of the City of Santa Monica hereby authorizes the
Mayor to submit, for and on behalf of the City of Santa Monica, a letter of support for
AB1612, the Cigarette Pollution and Litter Prevention Act of 2005.

SECTION 2. The City Council of the City of Santa Monica hereby agrees and
further does authorize the aforementioned representative to certify that the City will
support efforts of the Act to reduce cigarette pollution.
SECTION 3. The City Clerk shall certify to the adoption of this Resolution, and
henceforth and thereafter the same shall be in full force and effect.
