A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA MONICA REVISING VARIOUS PERMIT AND USER FEES
RELATED TO DEVELOPMENT REVIEW, RECORDS,
INSPECTION AND GENERAL SERVICES IN THE ENVIRONMENTAL
AND PUBLIC WORKS MANAGEMENT, FIRE, PLANNING AND COMMUNITY
DEVELOPMENT DEPARTMENTS AND SETTING NEW USER FEES IN THE
COMMUNITY AND CUl rURAL SERVICES DEPARTMENT
RELATED TO DEVELOPMENT REVI EW AND
ESTABLISHING THE COSTS OF STAFFING FOR CODE ENFORCEMENT
WHEREAS, the City of Santa Monica recently completed a study of existing and
proposed City fees charged for the provision of a variety of services and the processing of
a variety of applications for the purpose of updating fee amounts to reflect current costs of
services and processing; and
WHEREAS the recent study of fees demonstrates that in many ins.tances the full
costs of services to particular individuals are not being paid by those individuals because
fees do not reflect full costs; and
WHEREAS it is the policy of the City of Santa Monica to charge for the full costs of
services provided by City Staff when such services benefit individual users rather than
members of the community as a whole; and

WHEREAS, Chapter 8.08 of the Santa Monica Municipal Code adopts by Ordinance
certain administrative provisions from the model technical codes and deletes the fee tables
for permit, plan review and inspection fees found in these model codes and requires fees.
to be set forth by resolution of the City Council; and
WHEREAS, Ordinance Number 1754 (CCS) (the "Ordinance"), adopted July 12,
1994, governs the setting of the amount of user fees or fees for services provided to or for
the benefit of particular individuals rather than the general public; and
WHEREAS, the Ordinance allows such user fees or fees for services to be set by
ordinance, by a resolution adopted by the City Councilor by any other means authorized
by law; and
WHEREAS, the City desires to revise and establish permit and user fees charged by
the Environmental And Public Works Management Department, Fire Department, Planning
and Community Development Department and Community and Cultural Services
Department by this resolution in order to preserve public resources for the benefit of the
community as a whole and avoid diverting these resources to the ,benefit of individuals;
and,
WHEREAS, Chapter 1.08 and 1.09ofthe Santa Monica Municipal Code provide for
the recovery of administrative costs related to code enforcement, including staffing costs,
and the City recently conducted a study to determine the staffing costs per hour for various

employees involved in code enforcement,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:
SECTION 1. The user fees for services related to development review and the
administrative costs for code enforcement provided by the Community and Cultural
Services Department, Environmental Public Works Management Department, Fire
Department, and the Planning and Community Development Department, as shown in the
attached tables A, B, C, D, E and F are hereby adopted.
SECTION 2. The user fees related for services provided by the Police Department
related to Animal Control and the Office of Administrative Services, as shown in the
attached tables G and H, are hereby adopted.
SECTION 3. For the processing of checks for City services that have been
deposited by the City and returned unpaid by a financial institution, a fee of twenty-five
dollars ($25.00) per returned check is established.
SECTION 4. For conducting research for member of the public regarding City issues
by the City Clerk's office, a fee of twenty-five dollars per hour ($25,OO/hr) is established.
SECTION 5. Commencing upon July 1, 2003 and on July 1 of each fiscal year

SECTION 6, The user fees for services related to development review for the
Community and Cultural Services Department, Environmental And Public Works
Management Department, Fire Del3artment, and the Planning and Community
Development Department shall be effective on January 1. 2003. which is at least sixty (60)
days after adoption, in accordance with Government Code section 66017.
SECTION 7. Resolution Number 7211 (CCS) adopted May 13, 1986 and effective
May 13, 1986, Resolution Number 7607 (CCS) adopted April 26, 1988 and effective June
24, 1988, Resolution Number 8300 (CCS) adopted October 8, 1991 and. effective
November 7, 1991, Resolution Number 8866 (CCS) adopted February 28, 1995 and
effective May 1, 1995, Resolution Number 9408 (CCS) adopted June 22, 1999 and
effective September 1,1999, Resolution Number 9525 (CCS) adopted June 20, 2000 and
effective July 1, 2000, Resolution Number 9526 (CCS) adopted June 20, 2000 and
effective June 20. 2000, Resolution Number 9647 (CCS) adopted April 24, 2001 and
effective June 25, 2002, are hereby repealed.

SECTION 8. The City Clerk shall certify to the adoption of this resolution and
thenceforth and thereafter the same shall be in full force and effect.

2. "Affordable Housing Projects" as defined by Zoning Ordinance are exempt from
planning application fees,
3. In the case of projects requiring multiple permit applications that may be approved by
the same entity, the fee for the highest permit shall be charged, plus a multiple permit
application for any additional concurrently processed applications. If multiple permits
are required which cannot be approved by the same entity, or if an environmental
review is required, the full fee for such applications shall be charged. .
4. Non-administrative permit extensions shall be charged 50% of the full application fee
for the permit to be extended.

5. Applications for ARB review of buildings, which include proposed signage and/or
landscaping, shall be charged for the building review fee only. Should a sign adjustment
be required, a multiple application fee shall be charged in addition to the building review
fee; separate applications for signage and/or landscaping shall be charged the
sign/landscaping review fee.
6. A re-submittal for ARB approval of a design change shall be processed with no fee
charged unless a building permit has been issued for the project, in which case the
standard fee amounts shall be charged. A re-submittal, which includes signage
changes that would trigger a requirement for a sign adjustment, shall be charged the
sign adjustment fee.
l. Application fee refunds for withdrawn projects shall be processed as follows: application
not yet deemed complete - 90% refund: application deemed complete - 75% refund:
determination or Planning Commission or other board report drafted - 50% refund;
determination issued, ZA hearing conducted, Planning Commission or other board
report issued - 25% refund.
8. All planning fees for Administrative Approval applications shall be waived for
designated landmark structures and structures identified as contributing to designated
historic districts.
9. All Certificate of Appropriateness fees for any alteration, restoration, or construction, in
whole or in part, to a designated landmark or to structures identified as contributing to a
designated historic district shall be waived.
10. Antenna Use Permits for television reception only (TVRO) and ham radio antennas-
$25.00. All other antennas are charged the full Use Permit fee.
