R-10019 F:atty\muni\laws\mjm\eruv-1.doc City Council Meeting 2-22-05 Santa Monica, California RESOLUTION NUMBER 10019 (CCS) (City Council Series) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA AUTHORIZING THE CITY MANAGER TO ENTER INTO A LICENSING AGREEMENT WITH THE LOS ANGELES COASTAL ERUV COMMITTEE RELATING TO THE CREATION OF AN ERUV WHEREAS, the Los Angeles Coastal Eruv Committee has approached Los Angeles County and the City of Santa Monica to request their assent to the creation of an eruv; and WHEREAS, an eruv allows Orthodox Jews with impaired mobility or very young children to attend synagogue without violating the Talmudic prohibition against pushing or carrying heavy objects outside the home on the Sabbath; and WHEREAS, an eruv does this by creating a designated area which is considered to be an extension of the home; and WHEREAS, once an eruv is created, congregation members may, for instance, push baby carts, wheelchairs and walkers to and from the synagogue within the boundaries of the eruv; and WHEREAS, the proposed eruv would encompass the area to the south of the Santa Monica freeway and east of the beach, would be delineated by stringing thin 1 filament on existing structures, and would not necessitate the building or erection of any new structures or poles; and WHEREAS, the creation of the eruv would serve the public welfare by allowing many members of the community to freely exercise their religious beliefs, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1. The City of Santa Monica will cooperate in the Los Angeles Coastal Eruv Committee's creation of an eruv. SECTION 2. The City Manager is hereby authorized to enter into a licensing agreement allowing the Los Angeles Coastal Eruv Committee to string filament on existing poles, fences and buildings to create the eruv. SECTION 3. The City Clerk shall certify to the adoption of this Resolution, and thenceforth and thereafter the same shall be in full force and effect.
