A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA
ACCEPTING A $99,492 GRANT AWARD FROM THE STATE OF CALIFORNIA
DEPARTMENT OF ALCOHOLIC BEVERAGE CONTROL FOR THE CONDUCT
OF AN ENFORCING UNDERAGE DRINKING LAWS (EUDL) COMMUNITY
TRIALS ENFORCEMENT INITIATIVE PROJECT IN SANTA MONICA
WHEREAS, the federal Office of Juvenile Justice and Delinquency
Prevention (OJJDP) has provided funds to the State of California for the conduct
of the California Enforcing Underage Drinking Laws (EUDL)-Community Trials
Enforcement Initiative Project in various communities within California; and
WHEREAS, the State of California Department of Alcoholic Beverage
Control has been given authority to coordinate and administer the EUDL-
Community Trials Enforcement Initiative Project in California; and
WHEREAS, the Department of Alcoholic Beverage Control has offered a
$99,492 grant to the City of Santa Monica to finance the conduct of a two-year
EUDL-Community Trials Enforcement Initiative Project in Santa Monica; and
WHEREAS, the City of Santa Monica desires to undertake that certain
project designated as the California Enforcement of Underage Drinking Laws
(EUDL) Project, to be funded in part from federal grant funds made available
through the Local Law Enforcement Agencies Project administered by the
Department of Alcoholic Beverage Control (hereafter referred to as ABC);
NOW, THEREFORE, the City Council of the City of Santa Monica does
resolve as follows:
SECTION 1. The City Manager of the City of Santa Monica is authorized
to accept the $99,492 grant from ABC and to execute the related grant
agreement with ABC on behalf of the City, including any extensions or
amendments thereof and any subsequent agreements with the State in relation
thereto.
SECTION 2. IT IS AGREED that any liability arising out of the
performance of this agreement, including civil court actions for damages, shall be
the responsibility of the grant recipient and the authorizing agency. The State of
California and ABC disclaim responsibility for any such liability.

SECTION 3. IT IS FURTHER RESOLVED that grant funds received
hereunder shall not be used to supplant the expenditure of other funds controlled
by this body.
SECTION 4. IT IS ALSO AGREED that the project funded by this grant
award is not subject to local hiring freezes.
SECTION 5. The City Clerk shall certify to the adoption of this Resolution,
and thenceforth and thereafter the same shall be in full force and effect.
