R-9982 PD:JTB: DA: F\\police\share\staffrpt\JABG2004-res City Council Meeting: Santa Monica, California RESOLUTION NUMBER 9982 (CCS) (City Council Series) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA RELEASING CITY OF SANTA MONICA FUNDS AVAILABLE UNDER THE JUVENILE ACCOUNTABILITY INCENTIVE BLOCK GRANT TO THE COUNTY OF LOS ANGELES TO BE USED FOR THE PURPOSE OF HIRING A PROSECUTOR TO TARGET CURRENT, SERIOUS JUVENILE CRIME ISSUES IN OUR LOCAL COMMUNITIES. WHEREAS, grant funds are available for Fiscal Year 2004-2005 from the Juvenile Accountability Block Grant (JABG) Program for the purpose of working in collaboration with a Special Projects prosecutor to target current, serious juvenile crime issues in the City; and WHEREAS, this purpose can best be achieved by the City releasing its grant funds under JABG to the County of Los Angeles to hire a prosecutor to target current, serious juvenile crime issues in City. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1. The City of Santa Monica waives its right to receive its entire direct subgrant award and authorizes the funds to be expended by the County of Los Angeles 1 on condition that the funds be expended for the hiring of a prosecutor who will administer the Special Projects issues in our City. SECTION 2. The City Council authorizes the City Manager, or her designee, to negotiate and enter into an agreement with the County of Los Angeles for the hiring of a prosecutor who will administer the Special Projects issues in Santa Monica, the amount not to exceed the amount of the grant funds which were available to the City under the Juvenile Accountability Block Grant program. SECTION 3. The City of Santa Monica acknowledges and resolves that any liability arising out of the performance of these JABG Program funds, including civil court actions for damages, shall be the responsibility of the County of Los Angeles (" grant recipient"). The State of California, and the City of Santa Monica disclaim responsibility for any such liability. SECTION 4. The grant funds received hereunder shall not be used to supplant expenditures controlled by the City of Santa Monica. SECTION 5. The City Clerk shall certify to the adoption of this Resolution, and henceforth and thereafter the same shall be in full force and effect.
