A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA
SETTING THE AMOUNT OF FEES TO BE CHARGED FOR THE USE OF THE
SANTA MONICA SWIM CENTER AND MILES MEMORIAL PLAYHOUSE OPERATED
BY THE COMMUNITY AND CULTURAL SERVICES DEPARTMENT OF THE CITY OF
SANTA MONICA
WHEREAS, the municipal facilities managed by the Community and Cultural
Services Department of the City of Santa Monica are for use by the public; and
WHEREAS, it is the policy of the City of Santa Monica to charge for the use of City
facilities when such use benefits individuals rather than the community as a whole; and
WHEREAS, the Santa Monica Municipal Code authorizes the City to establish user
fees for services and opportunities provided to individuals rather than the general public
and authorizes setting the amount of such fees by resolution; and
WHEREAS, the City has calculated the cost of making various facilities available for
use by individuals and groups; and
WHEREAS, the City's policy is to discount fees for use of public facilities, when
possible, in order to ensure that individuals and groups will, in fact, be able to use the
facilities and to ensure that the facilities are utilized in a way that benefits this community
and community members most in need of programs which occur at the facilities; and
WHEREAS, the Santa Monica Swim Center offers a range of sports programs for
youth, persons with disabilities and adults; and
WHEREAS, the City Council wishes to adopt a fee schedule which will promote use
of the Swim Center by youth and community members; and
WHEREAS, fees for use of the Swim Center by the Santa Monica-Malibu Unified
School District and the Santa Monica Community College are governed by facilities
agreements between the City and those entities; and
WHEREAS, Miles Memorial Playhouse was conveyed to the City through a bequest
which required that the facility be dedicated to use by the community's youth; and

WHEREAS, the conditions of the bequest control the City's operation of the
Playhouse,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:
SECTION 1. Permit fees for use of the Santa Monica Swim Center shall be as
specified on Schedule "A" which is attached to and is part of this Resolution.
SECTION 2. Permit fees for use of Miles Memorial Playhouse shall be as specified
on Schedule "B" which is attached to and is part of this Resolution.
SECTION 3. Fees to be charged for use of the Santa Monica Swim Center and
Miles Memorial Playhouse but which are not listed in this Resolution shall be determined
by the Community and Cultural Services Director and shall be based upon the costs
incurred by the City in providing the facility or program.
SECTION 4. The fees set forth in this Resolution shall be effective July 1,2004.
SECTION 5. Resolution Number 9859 (CCS) is hereby repealed in its entirety.
SECTION 6. The City Clerk shall certify to the adoption of this Resolution, and
thenceforth and thereafter the same shall be in full force and effect.

~hese fees are in addition to any permits or licenses required for conducting business or filming in the City of Santa Monica.
A day is considered up to 8 consecutive hours. Users exceeding 8 hours will be charged the Resident Commercial rate for
each additional hour. Additional compensation may be required for filming in the event a scheduled activity or permit is displaced.
Definitions for Commercial Meetings/Events are stated on the Park Facility Usage Categories sheet. Insurance as determined
by the City's Risk Manager may be required. Additional fees may be assessed for damage to the facility interior, exterior
or its furnishings.
