R-9952 F:\A TTY\M UN I\LA WS\MOX\Firel nspectionFeeAmendmentFinal.doc City Council Meeting 6-15-04 Santa Monica, California RESOLUTION NUMBER 9952 (CCS) (City Council Series) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA AMENDING THE FEE PROVISIONS RELATING TO ANNUAL INSPECTION OF MULTI-FAMILY RESIDENCES AND NON-HIGH RISE COMMERCIAL BUILDINGS BY THE SANTA MONICA FIRE DEPARTMENT WHEREAS, on June 17,2003 the City Council of the City of Santa Monica adopted Resolution Number 9858 setting various fees for services provided by the Police Department, Fire Department and Records and Election Services Department, and WHEREAS, among the fees set by said Resolution Number 9858 (CCS) was the fee for annual inspection of multi-family residences and non-high rise commercial buildings by the Fire Department at the rate of sixty dollars ($60.00) per inspection ("Fire Inspection Fee"); and WHEREAS, the Fire Department performs these annual inspections and then bills the respective property owners for payment of the Fire Inspection Fee; and WHEREAS, in order to encourage timely payment of the Fire Inspection Fee and assure that the City recovers the costs of performing the inspections, the City desires to add a provision to the Fire Inspection Fee to allow the City to charge a late payment charge and interest on any portion of the unpaid Fire Inspection Fee, 1 ---.. , ~.~ -. ~-- -.-... NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1. If a property owner fails to pay the Fire Inspection Fee amount in full within thirty (30) days from the date of the billing invoice sent by the City, an additional late payment charge ("Late Payment Charge") shall be due and payable by the property owner. The Late Payment Charge will be equal to ten percent (10%) of any outstanding balance due for the Fire Inspection Fee. In addition, interest will accrue and be due on the remaining balance from the date the Fire Inspection Fee is delinquent. The interest will be in the amount determined by the Director of Finance as equal to the average rate of return on the City's pooled investment portfolio. SECTION 2. The City Clerk shall certify to the adoption of this Resolution, and thenceforth and thereafter the same shall be in full force and effect.
