A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF SANTA MONICA
ADOPTING THE NEGATIVE DECLAR:ATION FOR
AN 8-UNIT CONDOMINIUM PROJECT LOCATED AT 1311 CENTINELA AVENUE
WHEREAS, a Notice of Intent to Adopt an Initial Study for an 8-unit condominium
project located at 1311 Centinela Avenue was published on February 6, 2003 in
compliance with the California Environmental Quality Act (CEQA) and the City of Santa
Monica CEQA Guidelines; and,
WHEREAS, the Proposed Draft Negative Declaration was made available for public
comment for 30-days beginning on February 6, 2003 to March 10, 2003.
WHEREAS, on May 21, 2003 the Planning Commission initially considered the
proposed project and Negative Declaration and provided comments requiring additional
shade and shadow analysis as well as project revisions.
WHEREAS, on August 06, 2003 the Planning Commission considered the
proposed project, Negative Declaration, and technical memorandum, which addressed the
additional shade and shadow analysis and provided comments requiring additional project
revisions.

WHEREAS, neither project revisions nor the additional shade and shadow analysis
constituted a substantial revision to the Proposed Negative Declaration in that no new
avoidable significant effects were identified
WHEREAS, on October 01,2003, the Planning Commission, as Lead City Agency,
reviewed and approved the Initial Study and Proposed Ne~lative Declaration and proposed
project.
WHEREAS, on October 14, 2003, the Design Compatibility Permit, approved by the
Planning Commission on October 01, 2003, was appealed for review by the City Council
on November 11, 2003
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1 The City Council finds that the Initial Study identified no areas in
which the project would have a potentially significant impact.
SECTION 2. The City Council has reviewed and considered the Initial Study,
Negative Declaration and supplemental shade and shadow analysis, together with any
comments received during the public review process, prior to acting on the project.
SECTION 3. The City Council finds that, based on the whole record before it,
including the Initial Study, Negative Declaration and supplemental shade and shadow
analysis, and any comments received, there is no substantial evidence that the Project will
have a significant effect on the environment, and that the Negative Declaration reflects the

City's independent judgment and analysis. Therefore, the City Council hereby approves
the Negative Declaration
SECTION 4. Consistent with Public Resources Code Section 21081.6 (a) (2), the
documents which constitute the record of proceedings for approving this project are
located in the Planning and Community Development Department, 1685 Main Street,
Room 212, Santa Monica, California. The custodian of these records is Marika A
Modugno, AICP, Associate Planner in the City Planning Division of the Planning and
Community Development Department.
SECTION 5. The Planning Director shall certify to the adoption of this Resolution,
and thenceforth and thereafter the same shall be in full force and effect.

Company, Texaco Refining & Marketing, Inc., Exxon Mobil Corporation,
Chevron U.S.A. Inc., ChevronTexaco Corporaticln, Thrifty Oil Co., and Best
California Gas, Ltd., in the amount of $ 92.5 million, for clean up and restoration
