A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF SANTA MONICA DECLARING CERTAIN FIRE
HELMETS TO BE SURPLUS CITY PROPERTY AND
AUTHORIZING THE DISPERSAL OF THE HELMETS TO
FIRE DEPARTMENT PERSONNEL
WHEREAS, the Fire Department has obsolete fire helmets which have been
replaced; and
WHEREAS, the obsolete helmets cannot be used for their intended purpose
because they do not comply with Cal-OSHA standards; and
WHEREAS, the obsolete helmets are no longer needed or useable for any Fire
Department purpose or any other public purpose; and
WHEREAS, the City's Purchasing Agent has determined that these fire helmets
cannot be sold or given to anyone who might use them for their intended purpose because
they are not compliant with Cal-OSHA standards; and
WHEREAS, the Fire Department wishes to give the helmets to the Fire Department
personnel who wore them, to whom the helmets have sentimental value, on the condition
that the recipients agree never to use them as helmets or to sell them to anyone else,

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:
SECTION 1, The City's competitive bidding requirements are hereby waived for
the noncompliant fire helmets described above,
SECTION 2. The Fire Department is hereby authorized to give the noncompliant
fire helmets to the Fire Department personnel who wore them, provided each recipient
signs an agreement with the City not to use the fire helmet for its intended purpose or to
sell it to anyone else,
SECTION 3, The City Clerk shall certify to the adoption of this Resolution, and
thenceforth and thereafter the same shall be in full force and effect.
