R-9890 f:\plan\admin\downtown task force\roicode,doc City Council Meeting: September 9, 2003 Santa Monica, California RESOLUTION NO, 9890 (CCS) (City Council Series) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA DIRECTING THE PLANNING COMMISSION TO CONSIDER AN AMENDMENT OF THE TEXT OF THE CITY OF SANTA MONICA ZONING ORDINANCE RELATED TO NEW AND EXPANDED RESTAURANTS AND PERMITTED TYPES OF ALCOHOL LICENSES WHEREAS, the City has taken extensive efforts to maintain the unique character and mix of uses on the Third Street Promenade in the Sayside District; and WHEREAS, over the years, market forces have threatened the mix many times and the City has responded to preserve the Promenade's unique character through adoption of the Sayside District Specific Plan and adoption of laws and policies which promote the general welfare by maintaining the Promenade's eclectic character; and WHEREAS, the City Council established a Promenade Uses Task Force to study the Promenade issues, to seek feedback and input from the community, and to make recommendations to the City Council regarding the appropriate mix of uses on the Promenade; and WHEREAS, the Task Force met regularly beginning in May 2002 and completed its work in March 2003, during which time it considered goals and 1 objectives for the Promenade and the Downtown, reviewed relevant City policies and regulations, and conducted community workshops; and WHEREAS, the Task Force prepared a series of recommendation for review by the City Council, include recommendations which require amendment of the text of Santa Monica Zoning Ordinance; and WHEREAS, on June 10, 2003, the City Council reviewed the recommendations of the Task Force and directed staff to prepare a work plan for implementation of the Task Force recommendations; and WHEREAS, on September 9, 2003, the City Council reviewed the proposed work plan, which includes a series of proposed amendments to the City's zoning and planning regulations, including the Zoning Ordinance. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES HEREBY RESOLVE AS FOLLOWING: SECTION 1. Pursuant to the Santa Monica Municipal Code Section 9,04,20,16,020(a)(2), the City Council does hereby direct the Planning Commission to initiate an amendment of the City's Zoning Ordinance to implement the recommendations of the Promenade Uses Task Force, including, but not limited to, amendment of Section 9,04.08.15 to remove the limits on the number of permitted restaurants and to allow for off-site alcohol sales associated with specialty retailers and theaters and amendment of Section 9,04,10,18 to allow for administrative approval of new or expanded restaurants with alcohol 2 service that conform to pre-defined standards which ensure compatibility with adjacent uses and protection of the general health, safety and welfare, SECTION 2, The City Clerk shall certify to the adoption of the Resolution, and thenceforth and thereafter the same shall be in full force and effect.
