A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF SANTA MONICA
CERTIFYING THE FINAL ENVIRONMENTAL IMPACT REPORT
ON THE BOATHOUSE DEMOLITION AND CONSTRUCTION OF THE BUBBA GUMP
SHRIMP COMPANY RESTAURANT
WHEREAS, a Notice of Preparation of an Environmental Impact Report was
issued on August 20, 2002; and
WHEREAS, a Notice of Completion of a Draft Environmental Impact Report was
published on April 4, 2003, in compliance with the California Environmental Quality Act
and the City of Santa Monica CEQA Guidelines; and
WHEREAS, the Draft Environmental Impact Report was circulated for a 45-day
period which ended on May 19, 2003; and
WHEREAS, on June 5, 2003, the Final Environmental Impact Report was
published; and
WHEREAS, the Planning Commission reviewed and certified the Environmental
Impact Report and approved the project on June 18,2003, with conditions;
WHEREAS, the Bubba Gump Shrimp Co, appealed the Planning Commission's
decision, including mitigation measures required by the Environmental Impact Report;
WHEREAS, the City Council has reviewed and considered the contents of the Final
EIR in its decision-making process; and
WHEREAS, on September 9, 2003, the City Council, as Lead City Agency, reviewed
the Final Environmental Impact Report;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES HEREBY RESOLVE AS FOLLOWS:
SECTION The City Council has reviewed and considered the information
contained in the Final Environmental Impact Report on the Bubba Gump Shrimp Co.
Restaurant prior to acting on the project.
SECTION 2. The City Council certifies that the Final EIR for the project was
presented to the City Council, that the Final EIR for the project was completed in full
compliance with State law and City CEQA Guidelines, that there was adequate public
review of the Draft Environmental Impact Report, that it has considered all comments on

the Draft Environmental Impact Report and responses to comments, that the Final
Environmental Impact Report adequately discusses all significant environmental issues,
that the Final Environmental Impact Report reflects the independent judgement and
analysis ofthe City, and that the City Council has reviewed and considered the information
contained in the Final Environmental Impact Report in its decision-making process prior to
acting on the project.
SECTION 3. The City Clerk shall certify to the adoption of this Resolution, and
thenceforth and thereafter the same shall be in full force and effect.
