R-9878 f: \atty\m u n i\laws \barry\pierperformance-03, wpd City Council Meeting 7-22-03 Santa Monica, California RESOLUTION NUMBER 9878 (CCS) (City Council Series) A RESOLUTION OF THE CITY COUNCIL OF THE CITY.OF SANTA MONICA ESTABLISHING SIX TEMPORARY ZONES FOR STREET PERFORMERS AND PERSONS, INCLUDING VENDORS, UTILIZING TABLES OR CARTS FOR THE PURPOSE OF DISPLAYING OR DISTRIBUTING GOODS, WRITTEN MATERIALS, MERCHANDISE, OR FOOD ON THE PIER AND DESIGNATING THE NEW LOCATIONS AS THE TEMPORARY CENTRAL PERFORMANCE ZONE WHEREAS, the Santa Monica Pier has been in existence since 1908; and WHEREAS, the Santa Monica Pier is a very successful entertainment center with restaurants, arcades, a historic carousel, retail establishments, fishing and observation decks, an aquarium, and Pacific Park, an amusement park; and WHEREAS, visitors drive onto the Pier to park in a 286 space parking lot; and WHEREAS, the Pier has historically attracted large crowds, and the vehicular and pedestrian traffic has increased significantly since the opening of Pacific Park; and WH EREAS, the Pier has special events year round that attract thousands of visitors; and WHEREAS, ingress and egress from the Pier is very limited and the principal point of entry and exit for both pedestrians and vehicular traffic is the Pier bridge; and WHEREAS, on July 24, 2001, the City Council adopted Ordinance Number 2017 (CCS) which further detailed the special challenges to maintaining public safety on the Pier 1 and authorized the City Council to establish the special zones set forth in this Resolution; and WHEREAS, on July 24, 2001, the City Council adopted Resolution Number 9704 (CCS) which established three permitted zones for street performers and persons, including vendors, utilizing tables or carts for the purpose of displaying or distributing merchandise, goods, written materials, or food on the Pier; and WHEREAS, safety personnel and others have evaluated the potential for additional performance locations on the Pier; and WHEREAS, this assessment indicates that six new performance locations could be added to the Pier on a trial basis; and WHEREAS, five of the new locations would be along the handrail west of Pacific Park, which could accommodate five performances so long as the performers stay within five feet of the railing; and WHEREAS, the sixth new location would be in front of the former Boathouse Restaurant, near the center of the Boathouse Restaurant facade and behind the existing metal stanchions which have been installed to prevent vehicle damage to the structure; and WHEREAS, the six potential sites would be available to performers this summer on a trial basis, ending on December 1, 2003, NOW THEREFORE THE CITY COUNCIL OF THE CITY OF SANTA MONICA , DOES RESOLVE AS FOLLOWS: 2 SECTION 1, The City hereby establishes six additional temporary, permitted zones for street performers and persons, including vendors, utilizing tables or carts for the purpose of displaying or distributing merchandise, goods, written materials, orfood, on the Pier as reflected in Exhibit A to this Resolution, These areas are designated as the Temporary Center Performance Area and shall be considered as part of the Center Performance Area SECTION 2, This Resolution shall be of no further force or effect as of December 1, 2003.
