CITY COUNCIL SERIES
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA
ESTABLISHING AN UNDERGROUND UTILITY DISTRICT ALONG MARINE STREET,
BETWEEN LINCOLN BOULEVARD AND FREDERICK STREET
WHEREAS, Chapter 7.52 of the Santa Monica Municipal Code (the "Code") sets
forth the procedures for establishment of underground utility districts to perform the
removal of overhead utility facilities and replacement of such facilities by underground
installation; and
WHEREAS, the City Council desires to carry out City staff recommendations to
establish an underground utility district along Marine Street between Lincoln Boulevard
and Frederick Street, to be known as the Marine Street Underground Utility District, for
the purpose of moving certain existing utility facilities underground; and
WHEREAS, on May 13, 2003, the City Council of the City of Santa Monica set a
public hearing in accordance with Section 7.52.020 of the Code, to determine whether
the public necessity, health, safety or welfare requires the removal of overhead utility
facilities and replacement of those facilities by installation underground within a
designated area along Marine Street in the City, and

WHEREAS, in accordance with Section 7.52.020 of the Code, notice to affected
utilities and affected property owners was given at least 10 days prior to the public
hearing date set for July 8, 2003; and
WHEREAS, the City Engineer has consulted with affected utilities and
determined the extent of each utility company's participation, estimates of costs and the
estimated time required to complete the removal of overhead utility facilities and
installation of such facilities underground; and
WHEREAS, in accordance with State Public Utility Commission Rule 20-A,
("PUC Rule 20-A"), Southern California Edison (Edison) will, at its expense, replace its
existing overhead electric facilities with underground electric facilities in the designated
area along Marine Street; and
WHEREAS, on July 8,2003, the public hearing on the necessity for
establishment of the Marine Street Underground Utility District was held before the City
Council and all persons interested were given an opportunity to be heard and give
public testimony on whether such District should be established.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:

SECTION . The City Council hereby finds that the public necessity requires the
removal of certain existing overhead utility facilities and replacement of such facilities
underground along that portion of Marine Street located between Lincoln Boulevard and
Prospect Court in the City of Santa Monica.
SECTION 2. The Marine Street Underground Utility District is hereby established
for the purpose of carrying out all work necessary to move these existing overhead
utility facilities underground.
SECTION 3. The costs of the removal and underground installation of the utility
facilities in the Marine Street Underground Utility District shall be borne by Edison in
accordance with PUC Rule 20-A.
SECTION 4. The removal of the existing overhead utility facilities in the District
shall commence on or about December 31, 2004 and be completed by December 31
2005, unless the City extends the time period for completion of this work.
Section 5. The City Clerk shall certify to the adoption of this Resolution, and
thenceforth the same shall be in full force and effect.
