R-482 City Council Meeting: July 8, 2003 Santa Monica, CA RESOLUTION NUMBER 482 (RAS) (Redevelopment Series) A RESOLUTION OF THE REDEVELOPMENT AGENCY OF THE CITY OF SANTA MONICA CONSENTING TO THE USE OF SANTA MONICA REDEVELOPMENT AGENCY FUNDS FOR THE SANTA MONICA COLLEGE LIBERAL ARTS BUILDING REPLACEMENT PROJECT AND MAKING CERTAIN DETERMINATIONS AND FINDINGS PURSUANT TO HEALTH AND SAFETY CODE SECTION 33445 WHEREAS, the Redevelopment Agency of the City of Santa Monica (the "Agency") has prepared a Redevelopment Plan (the "Redevelopment Plan") for the Santa Monica Earthquake Recovery Redevelopment Project ("Project Area") which results in the allocation of taxes from the Project Area to the Agency for the purposes of redevelopment; and WHEREAS, the intent of the Redevelopment Plan is, in part, to provide for and facilitate the repair, restoration and/or replacement of facilities damaged as a result of a disaster and to perform specific actions necessary to prevent or mitigate against the effects of a disaster; and WHEREAS, the Agency proposes to assist with the cost of construction of the Santa Monica College Liberal Arts Building Replacement (the "Project"), located within the Project Area, which will be owned by the Santa Monica Community College District; and 1 WHEREAS, the Agency and Santa Monica College will enter into a Cooperation Agreement to provide a means of carrying out the Project; and WHEREAS, Section 33445(a) of the Health and Safety Code authorizes a redevelopment agency, with the consent of the legislative body and if the agency and the legislative body make certain determinations specified in Section 33445, to pay all or part of the cost of installation and construction of any publicly owned improvement; and WHEREAS, Agency staff has prepared a summary report, pursuant to Section 33679 of the Health and Safety Code ("33679 report"). The 33679 report has been made available to the public; and WHEREAS, all other legal prerequisites to the adoption of this Resolution have occu rred. NOW, THEREFORE, THE REDEVELOPMENT AGENCY OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1. Based upon substantial evidence in the record, including, without limitation, the 33679 report and the staff report, the Agency hereby finds and determines: 2 1) that the foregoing recitals are true and correct; (2) that the Project is of benefit to the Project Area; (3) that no other reasonable means of financing the Project is available to the community; (4) that the payment of funds for Project will assist the recovery from, and the elimination of one or more of the conditions resulting from, the 1994 Northridge Earthquake disaster; (5) that the payment of funds for the improvements will assist in elimination of one or more blighting conditions inside the Project Area by assisting in the elimination of one or more of the conditions resulting from the 1994 Northridge Earthquake disaster; and (6) that the payment of funds for the Project is consistent with the Agency's Five-Year Implementation Plan adopted pursuant to Section 33490 of the Health & Safety Code. SECTION 2. The Agency hereby consents to the use of Redevelopment Agency funds for the Santa Monica College Liberal Arts Building Replacement Project. SECTION 3. The Agency Executive Director is hereby authorized to negotiate and execute the Cooperation Agreement on behalf of the Agency, together with such non- substantive changes and amendments as may be approved by the Agency Executive Director and Agency General Counsel. The Agency Executive Director is authorized to 3 take any action and execute any and all documents and agreements necessary to implement the Cooperation Agreement. SECTION 4. The Secretary of the Agency shall certify the adoption of this Resolution and thenceforth and thereafter the same shall be in full force and effect.
