R-9858f:\atty\muni\laws\mjm\pdfireelectionfees.wpd City Council Meeting 6-17-03 Santa Monica, California RESOLUTION NUMBER 9858 (CCS) (City Council Series) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA SETTING VARIOUS FEES IN THE POLICE DEPARTMENT, FIRE DEPARTMENT AND RECORDS AND ELECTION SERVICES DEPARTMENT WHEREAS, it is the policy of the City of Santa Monica to charge the full costs of services provided by City staff when such services benefit individual users rather than members of the community as a whale; and WHEREAS, in many instances the full costs of services to particular indiv~duals are not being paid by those individuals because fees do not reflect full costs; and WI-IEREAS, Ordinance Number 1754 (CCS) (the "Ordinance"), adopted July 12, 1994, governs the setting of the amount of user fees or fees for services provided to or for the benefit of particular individuals rather than the general public; and WHEREAS, the Ordinance allows such user fees or fees for services to be set by ordinance, by a resolution of the City Council or by any other means authorize~+ by law; and WHEREAS, the City desires to set permit and user fees charged by the Police Department, Fire Department, and Records and Election Services Department by this Resolution in order to preserve public resources for the benefit of the community as a whole and avoid diverting these res~urces to the benefit of individuals, 1 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1 User fees for Police Department services shall be as shown in Attachment 1, which is attached to and is part of this Resolution. SECTION 2. The fee for annual inspection of multi-family residences and non-high rise commercial buildings by the Fire Departrnent shall be Sixth Dollars ($60.00) per inspection SECTION 3. Fees for Records and Election Services Department shall be as shown in Attachment 2, which is attached to and is part of this Resolution. SECTION 4. Commencing upon July 1, 2004, and on July 1 of each fiscal year thereafter, all fees established by Sections 1 through 3 of this Resolution, inclusive, with the exception of the $.20 per page duplicating fee, shall be administratively revised annually by a factor equal to the difference in the Los Angeles-Anaheim-Orange County Consumer Price Index for Wage Earners and Clerical Workers for the twelve (12) month period April through April of the prior fiscal year. No later than January 1, 2008, and at least five (5) year intervals thereafter, the City will conduct a comprehensive study of all fees set by this Resolution to determine if fees are adequately recovering City costs for these services and the results of the comprehensive study shall be reported to the Council, 2 SECTION 5. Tables G and H of Resolution Number 9807 (CCS) are hereby amended to reflect fee rates revised by this Resolution. SECTION 6.
