R-9869 f: \atty\m u n i\l aws \m j m \pa rki ngviolationfees. wpd City Council Meeting 6-24-03 Santa Monica, California RESOLUTION NUMBER 9869 (CCS) (City Council Series) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA SETTING CIVIL PENALTIES FOR PARKING VIOLATIONS AND FOR THE LATE PAYMENT OF PENALTIES WHEREAS, the City of Santa Monica is a municipal corporation; and WHEREAS, the California Vehicle Code authorizes the City to establish a schedule of parking penalties for parking violations and for the late payment of such penalties; and WHEREAS, California law provides that such penalties are civil in nature and are subject to administrative enforcement; and WHEREAS, California law provides that the amount of such civil penalties may be set by resolution, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1. The penalties specified in the attached "Schedule of Civil Penalties for Parking Violations and for Late Payments" are hereby established. SECTION 2. The penalties listed on the attached Schedule for a Santa Monica Municipal Code or California Vehicle Code section shall apply to all unlisted subsections. 1 SECTION 3. The violation of any federal, state, or local standing or parking regulation for which no provision is made in the attached Schedule shall have a civil penalty of Thirty-Eight Dollars ($38.00) and a delinquency penalty of Thirty-Eight Dollars ($38.00). SECTION 4. The City Clerk shall certify to the adoption of this Resolution, and thenceforth and thereafter the same shall be in full force and effect.
