RESOLUTION NO. 9850 (CCS)
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SANTA MONICA SETTING FEES FOR OVERNIGHT PARKING, FILMING AND
EVENT PERMITS AT SANTA MONICA AIRPORT
WHEREAS, it is the policy of the City of Santa Monica to charge
for the full costs of services provided by City Staff when such services benefit
individual users rather than members of the community as a whole; and
WHEREAS, Ordinance No. 1754 (CCS) (the Ordinance), adopted
July 12, 1994, provides guidance on the setting of the amount of user fees or
fees for services provided to, or for the benefit of, particular individuals rather
than the general public, and
WHEREAS, the Ordinance allows such fees for services to be set
by ordinance, by a resolution adopted by the City Council, or by any other
means authorized by law; and
WHEREAS, the policy of Ordinance 1754 is that user fees for services
benefiting specific individuals address the costs associated with the those
services or facilities in a manner that is proportional to the resources impacted;
and

WHEREAS, Chapter 3.04 of the Municipal Code requires a permit for
parking in City lots between the hours of three AM and five AM, and
WHEREAS, the parking of cars in the lots on the airport overnight requires
the processing of overnight parking permits by Airport Administration and the
active monitoring by Airport Police Officers, and
WHEREAS, Section 4.68.040 of the Municipal Code, amended in 2001
established policies, requirement and procedures for the issuance of Event
Permits; and
WHEREAS, the responsibility for the processing and issuance of event
permits for events at the Airport was reassigned from the Events Committee to
Airport Administration; and
WHEREAS, Airport Administration processes and coordinates all events
at the Airport following the same procedures and requirements as the City's
Event Permit Office as well as addressing the unique concerns associated with
Airport access, security and safety; and

WHEREAS, under Section 4.68.080 of the Municipal Code the City
Council is authorized to establish by resolution and from time to time amend fees
for event permits; and
WHEREAS, Section 10.04.06.200 of the Municipal Code requires the
issuance of a film permit for filming and commercial photography at the airport
and authorizes the City Council to establish and from time to time amend film
permit fees for the Airport, and
WHEREAS, Airport film permit processing addresses the same
procedures, requirements and issues as does other city location film permitting
as well as the unique concerns and coordination associated with airport access,
security and safety, and
WHEREAS, the current Airport film permit fees of $250 for motion
pictures/video production and $100 for commercial still photography are
consistent with other city film permits, however this fee is currently only applied to
filming on non-leased Airport property, and
WHEREAS, almost all filming activities are on leased Airport properties
and the cost of processing and coordinating film permits are the same for leased
and non-leased Airport property

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:
SECTION 1. The fee for overnight parking permits issued in conformance
with Chapter 3.04 of the Municipal Code shall be $5.00 per night per vehicle.
SECTION 2 The event permit fees adopted by resolution of the City
Council under Section 4.68.080 of the Municipal Code for City event permits shall
equally apply to Airport event permits.
SECTION 3. The filming permit fees adopted by the City Council pursuant
to Section 10.04.06.200 of the Municipal Code shall apply to all permits for any airport
property, whether leased or not.
SECTION 4. The City Clerk shall certify to the adoption of this Resolution,
and thenceforth and thereafter the same shall be in full force and effect.
