A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF SANTA MONICA APPROVING A REIMBURSEMENT
AGREEMENT, CONSENTING TO THE USE OF SANTA MONICA
REDEVELOPMENT AGENCY FUNDS FOR THE SANTA MONICA MAIN
LIBRARY SUPPLEMENTAL PUBLIC PARKING PROJECT AND MAKING
CERTAIN DETERMINATIONS AND FINDINGS PURSUANT TO HEALTH
AND SAFETY CODE SECTION 33445
WHEREAS, the Redevelopment Agency of the City of Santa Monica (the
"Agency") has adopted a Redevelopment Plan for the Santa Monica Earthquake
Recovery Redevelopment Project (the "Redevelopment Plan") which results in the
allocation of taxes from the Project Area to the Agency for the purposes of
redevelopment; and
WHEREAS, the Agency proposes to assist with the cost of construction of the
Supplemental Parking Facility (the "Project"), which is located within the Santa Monica
Earthquake Recovery Redevelopment Project, and which will be publicly-owned
although not by the Agency; and
WHEREAS, in order to facilitate the Project, the City and Agency have prepared
a Reimbursement Agreement which provides for reimbursement by the Agency to the
City of the Agency's portion of the costs of the Project; and

WH'EREAS. Section 33445(8)," the Health .. Saftdy Code authorizes a
redevelopment agency to pay all or part of the cost of installation and construction of
any.publ~ owned impnMment with '. eonsentofthe legisldve body if the ~
and legislative body make specified findings.

DOES RESOLVE AS FOLLOWS:
SECTION 1. The City Council hereby finds and determine that:
(1) the proposed Project is of benefit to the Project Area;
(2) no reasonable means of financing the Project other than that set forth in the
Reimbursement Agreement is available to the community;
(3) the payment of funds for the Project will assist the recovery from, and the elimination
of one or more of the conditions resulting from, the 1994 Northridge Earthquake
disaster;
(4) the payment of funds for the Project will assist in elimination of one or more blighting
conditions inside the Project Area by assisting in the elimination of one or more of
the conditions resulting from the 1994 Northridge Earthquake disaster; and
(5) the Project is consistent with the implementation plan adopted pursuant to Section
33490.

SECTION 2. The City Council hereby consents to the use of Santa Monica
Redevelopment Agency funds for the Santa Monica Main Library Supplemental Public
Parking Project. The City Council hereby approves the Reimbursement Agreement in
substantially the form presented to the City Council. The City Manager is hereby
authorized to execute the Reimbursement Agreement on behalf of the City, together
with such non-substantive changes and amendments as may be approved by the City
Manager and City Attorney. The City Manager is authorized to take any action and
execute any and all documents and agreements necessary to implement the
Reimbursement Agreement.
SECTION 3. The City Clerk shall certify the adoption of this Resolution, and
thenceforth and thereafter the same shall be in full force and effect.
