R-480 Agency Meeting: January 28, 2003 Santa Monica, CA RESOLUTION NUMBER 480 (RAS) (Redevelopment Series) A RESOLUTION OF THE REDEVELOPMENT AGENCY OF THE CITY OF SANTA MONICA APPROVING A REIMBURSEMENT AGREEMENT AND MAKING CERTAIN DETERMINATIONS AND FINDINGS PURSUANT TO HEALTH AND SAFETY CODE SECTION 33445 WHEREAS, the Redevelopment Agency of the City of Santa Monica (the "Agency") has adopted a Redevelopment Plan for the Santa Monica Earthquake Recovery Redevelopment Project (the "Redevelopment Plan") which results in the allocation of taxes from the Project Area to the Agency for the purposes of redevelopment; and WHEREAS, the intent of the Redevelopment Plan is, in part, to provide for and facilitate the repair, restoration and/or replacement of facilities damaged as a result of a disaster and to perform specific actions necessary to prevent or mitigate against the effects of a disaster; and WHEREAS, the Agency proposes to assist with the cost of construction of the Supplemental Parking Facility (the "Project"), which is located within the Santa Monica Earthquake Recovery Redevelopment Project, and which will be publicly-owned although not by the Agency; and 1 WHEREAS, in order to facilitate the Project, the City and Agency have prepared a Reimbursement Agreement which provides for reimbursement by the Agency to the City of the Agency's portion of the costs of the Project; and WHEREAS, Section 33445(a) of the Health and Safety Code authorizes a redevelopment agency to pay all or part of the cost of installation and construction of any publicly owned improvement with the consent of the legislative body if the agency and the legislative body make specified findings. NOW, THEREFORE, THE REDEVELOPMENT AGENCY OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOllOWS: SECTION 1. The Agency hereby finds and determine that: (1) the proposed Project is of benefit to the Project Area; (2) no reasonable means of financing the Project other than that set forth in the Reimbursement Agreement is available to the community; (3) the payment of funds for the Project will assist the recovery from, and the elimination of one or more of the conditions resulting from, the 1994 Northridge Earthquake disaster; (4) the payment of funds for the Project will assist in elimination of one or more blighting conditions inside the Project Area by assisting in the elimination of one or more of the conditions resulting from the 1994 Northridge Earthquake disaster; and 2 (5) the Project is consistent with the implementation plan adopted pursuant to Section 33490. SECTION 2. The Agency hereby approves the Reimbursement Agreement in substantially the form presented to the Agency. The Agency Executive Director is hereby authorized to execute the Reimbursement Agreement on behalf of the Agency, together with such non-substantive changes and amendments as may be approved by the Agency Executive Director and Agency General Counsel. The Agency Executive Director is authorized to take any action and execute any and all documents and agreements necessary to implement the Reimbursement Agreement. SECTION 3. The Secretary of the Agency shall certify the adoption of this Resolution, and thenceforth and thereafter the same shall be in full force and effect.
