R-9745f:\atty\mu n i\laws\mox\6th Cou rtAI IeyVac.O rderReso.wpd City Council Meeting 02-12-02 Santa Monica, California RESOLUTION NO. 9745 (CCS) (CITY COUNCIL SERIES) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA ORDERING THE VACATION OF EXCESS PUBLIC STREET RIGHT-OF-WAY AND PUBLIC SERVICE UTILITY EASEMENTS LOCATED IN A PORTION OF SIXTH COURT ALLEY IN THE CITY OF SANTA MONICA WHEREAS, the City has determined that the existing public street right-of-way and public service utility easements in the real property described in Section 1 of this Resolution (the "Property") are no longer needed for the purposes acquired and that said excess public street right of way and public service utility easements located therein are not needed for street, utility or any other public use; and WHEREAS, the City owns certain real property abutting the Property in the City of Santa Monica; and WHEREAS, on December 18, 2001, the City Council of the City of Santa Monica directed the City Clerk to set a public hearing regarding the proposed vacation of the excess public street right-of-way and public service utility easements; and WHEREAS, on January 22, 2002, the public hearing was continued to February 12, 2002; and 1 WHEREAS, on January 31 and February 6, 2002, notice of the proposed vacation was published in the Los Angeles Times as required by California Streets and Highways Code Section 8322; and WHEREAS, on January 28, 2002, notices of the proposed vacation were posted as required by California Streets and Highways Code Section 8323; and WHEREAS, the public hearing on this matterwas held on February 12, 2002; and NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS SECTION 1 The City Council of the City of Santa Monica orders vacation of the excess public street right-of-way and public service utility easements located on, above, and beneath the Property, as described in the legal description set forth in Exhibit "A" and as depicted in the drawing in Exhibit "B", both of which exhibits are attached hereto and incorporated herein by reference. SECTION 2. From and afterthe date this Resolution is recorded, the excess public street right-of-way and public service easements existing in the Property as of the date hereof shall no longer exist, SECTION 3, This vacation is completed in accordance with the provisions of the 2 California Streets and Highways Code, Part 3, "Public Street, Highways and Service Easements Vacation Law", Chapter 3, "General Vacation Procedure" SECTION 4. Pursuant to California Streets and Highways Code Section 8325, the City Clerk shall cause a certified copy of this Resolution, attested by the Clerk under seal, to be recorded in the office of the County Recorder of the County of Los Angeles. Upon such recordation, the vacation shall be complete. SECTION 5, The City Clerk shall certify to the adoption of this Resolution, and thenceforth and thereafter the same shall be in full force and effect.
