The City Council of the City of Santa Monica does hereby approve and authorize the City Manager to execute the Amendment to the Memorandum of Understanding ratified by the Santa Monica Police Officers Association, a copy of which is attached hereto. Section 2. The City Clerk shall certify to the adoption of this Resolution, and thenceforth and thereafter the same shall be in full force and effect. Stewart AMENDMENT TO THE MEMORANDUM OF UNDERSTANDING BETWEEN CITY OF SANTA MONICA, CALIFORNIA AND SANTA MONICA POLICE OFFICERS ASSOCIATION WHEREAS, the Memorandum of Understanding between the City of Santa Monica and the Santa Monica Police Officers Association (SMPOA) has been in effect since July 1, 1999; and WHEREAS, Section 4.03 (Sick Leave) provides that an employee can use sick leave because of the illness or injury of the employee's dependent spouse or children; and WHEREAS, the City of Santa Monica and the Santa Monica Police Officers Association wish to modify Section 4.03 of the existing Memorandum of Understanding to allow an employee to use sick leave because of the illness of any member of the employee's household; NOW, THEREFORE, both parties to the Memorandum of Understanding between the City of Santa Monica and the Santa Monica Police Officers Association agree to modify the existing Memorandum of Understanding by replacing Subsection A of Section 4.03 (Sick Leave) with the following language: A. Sick leave shall be defined as: Absence from duty because of the employee's illness or an off-the-job injury, exposure of the employee to contagious disease as evidenced by certification from 1 an accepted medical authority, medical or dental appointments of the employee or the employee's dependent children which could not be scheduled during non-work hours, with proper advance notification to the employee's supervisor, or illness or injury of the employee's dependent spouse or children. For the purposes of this section, an employee's domestic partner and the children of the employee's domestic partner would be covered by this provision. Except as expressly modified herein, all other terms and conditions set forth in the Memorandum of Understanding (MOU) between the City of Santa Monica and the Santa Monica Police Officers Association shall remain in full force and effect. IN WITNESS WHEREOF, the parties have executed this Modification to the Memorandum of Understanding between the City of Santa Monica and the Santa Monica Police Officers Association as of the date of the adoption of this modification by City Council.
