R-14 . . e e RESOLUTION NO. 14 (Housing Authority Serles) RESOLUTION OF THE HOUSING AUTHORITY OF THE CITY OF SANTA MONICA DETERMINING THAT DEVELOP- ~lliNT SHOULD BE EXEMPT FROM EMERGENCY BUILDING MORATORIUM PURSUANT TO SECTION 3(b) WHEREAS, Seavlew Paclflc, Ltd., and SeaVlew Pacific Owners ASsoclatlon des1re to enter lnto an agreement with the Housing Authorlty of the C1ty of Santa Monlca to lmpose restrlct10ns on real property located at 601 PaciflC Street, Santa Monlca; and WHEREAS, the agreement provides that one of seven condoID1n1Uffi units to be developed at the property wll1 be rented to low lncome persons; and WHEREAS, Sectlon 3(b) of Ordinance No. 1207 authorizes the Houslng Authorlty of the Clty of Santa Monlca to determine that the development be exempt from the Emergency Buildlng Moratorium thereln establlshed. NOW, THEREFORE, THE HOUSING AUTHORITY OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1. The development as set forth ln the Agreement Imposlng Restrlctlons on Real Property to be entered into between the Houslng Authority of the City of Santa Monica, Seavlew Pacific, Ltd., Seaview Paclflc Owners Association, and the California Coastal CommlSSlon, lS exempt from the Emergency BUllding MoratorlUID subJect to the condltlon set forth in Sect10n 2 of thlS resolutlon. e e SECTION 2. Wlth~n th~rty (30) days of the adopt1on of th~s resolutlon Seaview Pac1flc, Ltd., w111 agree ln writing that on or before the commencement of constructlon of the development descr~bed above ~t w~ll pay the Houslng Authority of the City of Santa Monlca a fee 1n 11eu of provid1ng a second low income unit ~n the development computed as follows: Thirty-three Thousand Four Hundred Dollars ($33,400) if all required approvals and variances can be obta1ned to ellminate two (2) parklng spaces, or Twenty-seven Thousand Dollars ($27,000) ~n the event that such approval cannot be obtained. SECTION 3. The Secretary Pro Tempore shall certify to the adoptlon of thlS resolutlon, and thenceforth and thereafter the same shall be ln full force and effect.
