R-9657 RESOLUTION NO. 9657 (ees) (CITY COUNCIL SERIES) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA AUTHORIZING THE CITY MANAGER TO EXECUTE AN AMENDMENT TO THE MEMORANDUM OF UNDERSTANDING WITH THE ADMINISTRATIVE TEAM ASSOCIATES WHEREAS, the City administration and representatives oftheAdministrative Team Associates have met and conferred under the terms of Ordinance No. 801 (CCS) and have reached agreement on wages, hours and other terms and conditions of employment; and WHEREAS, Section 2.06 of Ordinance No. 801 (CCS) of the City of Santa Monica requires preparation of a written Memorandum of Understanding between the administration and employees if an agreement can be reached; and WHEREAS, Section 2.06 of Ordinance No. 801 (CCS) further provides that any such Memorandum of Understanding shall not be binding unless and until presented to the governing body for determination; and WHEREAS, the purpose of the Memorandum of Understanding is to promote and provide harmonious relations, cooperation, and understanding between the City and the Administrative Team Associates; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: Section 1. The City Council of the City of Santa Monica does hereby approve and authorize the City Manager to execute the Amendment to the Memorandum of Understanding ratified by the Administrative Team Associates, a copy of which is attached hereto. Section 2. The City Clerk shall certify to the adoption of this Resolution, and thenceforth and thereafter the same shall be in full force and effect. APPROVED AS TO FORM: (wpfiles\labonother\AT A.Resolutlon.Amendment to 1996.2001 MOU.061201) AMENDMENT TO THE MEMORANDUM OF UNDERSTANDING BETWEEN CITY OF SANTA MONICA, CALIFORNIA AND ADMINISTRATIVE TEAM ASSOCIATES WHEREAS, the Memorandum of Understanding between the City of Santa Monica and the Administrative Team Associates (ATA) has been in effect since July 1, 1999; and WHEREAS, Section 3.01 (Health Insurance) Subsection A sets forth the medical insurance provision for ATA employees; and WHEREAS, the City of Santa Monica and the Administrative Team Associates wish to modify Subsection A of Section 3.01 of the existing Memorandum of Understanding to place AT A employees under an Umbrella Agreement which provides medical insurance for all Miscellaneous City employees covered by the California Public Employees' Retirement System (CaIPERS); NOW, THEREFORE, both parties to the Memorandum of Understanding between the City of Santa Monica and the Administrative Team Associates agree to modify the existing Memorandum of Understanding by replacing Subsection A of Section 3.01 (Health Insurance) with the following language: 1 Effective July 1, 2001, the medical insurance provision for employees covered hereunder is set forth in an umbrella agreement which covers City bargaining units represented by the Coalition, which is comprised of the following City bargaining units as of July 1, 2001: Administrative Team Associates (ATA), Management Team Associates (MT A), Municipal Employees Association (MEA), Public Attorneys Union (PAU), Public Attorneys' Legal Support Staff Union (PALSSU), Supervisory Team Associates (ST A) and United Transportation Union (UTU), as well as members of the Executive Pay Plan (EPP). Except as expressly modified herein, all other terms and conditions set forth in the Memorandum of Understanding (MOU) between the City of Santa Monica and the Administrative Team Associates shall remain in full force and effect. IN WITNESS WHEREOF, the parties have executed this Modification to the Memorandum of Understanding between the City of Santa Monica and the Administrative Team Associates as of the date of the adoption of this modification by City Council. -_..~.
