A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DECLARING ITS INTENTION TO ORDER VACATION OF A PORTION OF EXCESS
PUBLIC RIGHT-OF-WAY ALONG 26T" STREET IN THE CITY OF SANTA MOWICA
AND SETTING A PUBLIC HEARING FOR DECEMBER 19, 2000
WHEREAS, the City of Santa Monica has determined that the portion of the public
right-of-way described in Section 1 of this Resolution (the "Property") is no longer needed
for the purpose acquired and that said excess pubic right-of-way is not needed for street
or any other public use; and
WHEREAS, since utility lines and appurtenant structures are located on, above or
beneath the Property, the City Council of the City of Santa Monica will reserve easejments
in favor of public and private utility companies and their respective agents, employees and
representatives for purposes of construction, operation, maintenance, repair, removal and
replacement of all sewer, water, storm drain, street lights, traffic signals, electricall, gas,
telephone, cable TV and other utility facilities and improvements; and ~
WHEREAS, in connection with the Cloverfield Boulevard Widening Project tFhe City
filed condemnation proceedings to acquire real property necessary forthe Project inc~luding
property located on the east side of Cloverfield Boulevard; and ~
WHEREAS, 1723 Cloverfield Partners is the owner of certain real property which
abuts Cloverfield Boulevard and 26`h Street in the City of Santa Monica; and
WHEREAS, a portion of 1723 Cloverfield Partners' property on the east ~ide of
Cloverfield Boulevard (the "Condemned Parcel") was one of the parcels which the City

at 1685 Main Street in the City of Santa Monica. At such time and place all persons
interested in or objecting to the proposed vacation proceedings may appear before~lthe City
Council and offer evidence in relation thereto. I~
SECTION 4. The Director of Environmental and Public Works Management
Department is hereby directed to cause notices of street vacation to be posted as r~equired
by California Streets and Highways Code Section 8323. ~
SECTION 5. The City Clerk of the City of Santa Monica is directed to caus{e notice
of the date, hour and place of the public hearing to be published once a week for at least
two consecutive weeks priorto the hearing as required by California Streets and Hyghways
Code Section 8322. '
SECTION 6. The City Clerk shall certify to the adoption of this Resoluti~On, and
thenceforth and thereafter the same shall be in full force and effect. I
