SR 01-08-2019 2B City Council Report City Council Meeting: January 8, 2019 Agenda Item: 2.B 1 of 2 To: Mayor and City Council From: Denise Anderson-Warren, City Clerk, Records and Election Services Department Subject: Acceptance of Councilmember Vazquez's resignation, declare vacant seat, and discuss options to fill vacancy Recommended Action Staff recommends that the City Council accept Councilmember Vazquez’s letter of resignation, adopt the attached Resolution declaring a vacancy on the City Council, discuss next steps for filling the vacancy in accordance with Section 603 of the City Charter, and direct staff accordingly. Discussion On November 6, 2018, Councilmember Vazquez was elected to a seat on the California State Board of Equalization. Because this office is incompatible as a matter of law with service on the City Council, Councilmember Vazquez has stated his intent to voluntarily relinquish his City Council seat, effective January 7, 2019, when he will be sworn into office with the State Board of Equalization. Santa Monica City Charter Section 603 states that any vacancy on the City Council “shall be filled by appointment by the City Council, with the appointee holding office until the first Tuesday following the next general municipal election and until the appointee’s successor is elected and qualified.” Section 603 further provides that, should the Council fail to fill a vacancy by appointment within thirty days after the office has been declared vacant, the Council shall forthwith cause an election to be held to fill the vacancy. In the past two decades, the Council’s practice when a City Council seat has become vacant has been to approve a motion to accept applications from residents for the vacant seat, direct staff to publish notices of the vacancy in appropriate locations, and set a deadline for the receipt of applications and letters of interest. In preparation for the vacancy, the City Clerk’s Office is prepared to open the online 2 of 2 application process for interested applicants from no later than noon on Wednesday, January 9, 2019, through noon on Thursday, January 17, 2019. Applicants would then be considered by Council at its January 22, 2019 meeting. Notices advertising the vacancy will be posted on the City’s website and social media sites, by distribution to local media sources and in other appropriate locations. Financial Impacts & Budget Actions The recommendation presented in this report does not have a budget or fiscal impact. There is no financial impact for a City Council appointment to fill the vacancy. If Council chooses to call a special election, staff will return with additional documents and information concerning costs. Written Comments 1 City Council Meeting: January 8, 2018 Santa Monica, California RESOLUTION NUMBER (CCS) (City Council Series) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA DECLARING A VACANCY ON THE CITY COUNCIL WHEREAS, on November 6, 2018, Councilmember Tony Vazquez was elected to a seat on the California State Board of Equalization; and WHEREAS, state law governing incompatible offices prohibits an individual from serving simultaneously on both the State Board of Equalizat ion and the City Council of the City of Santa Monica; and WHEREAS, Councilmember Vazquez has submitted a letter of resignation stating his intent to voluntarily relinquish his seat on the City Council effective January 7, 2018, the date on which he was sworn in to the State Board of Equalization; and WHEREAS, City Charter Section 603 governs the filling of vacancies on the City Council; and WHEREAS, Section 603 provides that the City Council shall fill a vacancy on the City Council by appointment but must do so within thirty days of declaring the office vacant; and 2 WHEREAS, in order to start the appointment period, the City Council must declare the existence of the vacancy. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1. The election of Councilmember Tony Vazquez to the State Board of Equalization has created a vacancy on the City Council of the City of Santa Monica. SECTION 2. Councilmember Vazquez’s seat is hereby declared vacant. SECTION 4. The City Clerk shall certify to the adoption of this Resolution, and thenceforth and thereafter the same shall be in full force and effect.
