sr-032712-3fCity Council Meeting: March 27, 2012 Agenda Item: a® F To: Mayor and City Council From: Marsha Jones Moutrie, City Attorney Subject: Adding Martin Luther King, Jr. Holiday as one of the Holidays for Which Special Performance Hours Apply on the Third Street Promenade, The Transit Mall, and The Pier Recommended Action Staff recommends that the City Council adopt the attached resolution, adding Martin Luther King, Jr. Holiday to the list of holidays for which there are special street performance hours on the Third Street Promenade, the Transit Mall and the Pier. Executive Summary The Santa Monica Municipal Code establishes some limitations upon the time, place and manner of street performance occurring on the Promenade, Pier and Transit Mall, which are intended to protect circulation, emerging ingress and egress, and other aspects of public safety and welfare. Among these are restrictions are the hours during which street performers may work, with special, longer hours for weekends and holidays. The Code provision listing the holidays does not presently include Martin Luther King, Jr. Day. The attached resolution would add it to the list. Background Santa Monica Municipal Code Section 6.112.030 establishes generally applicable rules and regulations for street performance, including a formula establishing special holiday performance hours for the Third Street Promenade, Pier and Transit Mall. Basically, this formula treats holidays as though they were Saturdays or Sundays, depending upon the holiday's day of the week. The currently listed holidays are: New Year's Day, President's Day, Memorial Day, Independence Day, Columbus Day, Labor Day, Veterans Day, Thanksgiving Day and Christmas Day. 1 Discussion The attached resolution would add Martin Luther King, Jr. Day to the holiday list. This would effectuate the City's existing policy of allowing for longer performance hours on holidays. If this resolution is adopted, performance hours for Martin Luther King, Jr. Day (which always falls on Monday) will be the same as for the Sunday (9 a.m. to 11 p.m. on the Promenade and Transit Mall; 9 a.m. to 1:00 a.m. on the Pier). Hours would also be extended on the day before to be the same as for Saturday. Financial Impacts & Budget Actions Adoption of this resolution will not cause any financial impacts for the City.
