SUBJECT: Resolution Authorizing the city Manager to Execute
Amendment to the Memorandum of Understanding with the
Municipal Employees Association
INTRODUCTION
This report requests that Council adopt the attached Resolution
authorizing the city Manager to execute an amendment to the
Memorandum
of
Understanding wi th the Municipal
Employees
Association.
BACKGROUND
The Memorandum of Understanding for the Library bargaining unit,
the Library Guild & Library Non-Professionals, AFSCME, Local 1634,
expired as of June 30, 1992. On September 9, 1992, the members of
that bargaining unit voted to decertify.
As a result of the
decertification of the Library bargaining unit, each of the Library
job classes can now be transferred to an existing city bargaining
unit which would most appropriately represent that job class based
on a community of interest between the job class being transferred
and the job classes already represented by that bargaining unit.
The Library clerical and technical job classifications are being
transferred to the Municipal Employees Association (MEA) bargaining
unit. MEA agreed to open their MOU, and negotiations commenced to

amend the MEA MOV in such a way to accommodate some unique working
conditions (e.g. split shift differential and overtime for regular
work hours scheduled on Sunday) of the Library clerical and
technical employees. In addition, an equity adjustment is being
given to two Library clerical and technical job classifications
(Library Assistant and Literacy Program Assistant) in order to
align the salary established for those two job classifications with
the salary established for a job classification already represented
by MEA (Staff Assistant IV). This salary alignment is based on
internal equity factors. The result of these negotiations is the
attached amendment to the MEA MOV.
BUDGET{FINANCIAL IMPACT
Funds are included in the budget for fiscal year 1992-93 to cover
all salary costs related to adoption of the attached Resolution.
RECOMMENDATION
It is recommended that City council adopt the attached Resolution
authorizing the city Manager to execute an amendment to the
Municipal Employees Association (MEA) Memorandum of Understanding.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA MONICA AUTHORIZING THE CITY MANAGER
TO EXECUTE AN AMENDMENT TO THE
MEMORANDUM OF UNDERSTANDING WITH THE
MUNICIPAL EMPLOYEES ASSOCIATION
WHEREAS, the City administration and representatives of
the Municipal Employees Association have met and conferred under
the terms of Ordinance No. 801 (CCS) and have reached agreement on
an amendment to the current Memorandum of Understanding covering
the wages, hours and other terms and conditions of employment; and
WHEREAS, Section 2.06 of Ordinance No. 801 (CCS) of the
City of santa Monica requires preparation of a written Memorandum
of Understanding, including any amendments to said Memorandum of
Understanding, between the administration and employees if an
agreement can be reached; and
WHEREAS, Section 2.06 of Ordinance No. 801 (CCS) further
provides that any such Memorandum of Understanding, and any
amendments to said Memorandum of Understanding, shall not be
binding unless and until presented to the govern1ng body for
determination; and
WHEREAS, the purpose of the Memorandum of Understanding,
and any amendments to said Memorandum of Understanding, is to
promote and provide harmonious relations, cooperation, and
understanding between the city and the Municipal Employees
Association;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES RESOLVE AS FOLLOWS:
Section 1. The City Council of the City of Santa Monica
does hereby approve and authorize the city Manager to execute the
amendment to the Memorandum of understanding executed by the
Municipal Employees Association, a copy of which is attached
hereto.
Section 2. The City Clerk shall certify to the adoption
of this Resolution, and thenceforth and thereafter the same shall
be in full force and effect.

AMENDMENT
MEMORANDUM OF UNDERSTANDING
BETWEEN
CITY OF SANTA MONICA, CALIFORNIA
AND
MUNICIPAL EMPLOYEES ASSOCIATION
The term of the current Memorandum of Understanding (MOU) between
the City of Santa Monica and the Municipal Employees Association is
from July 1, 1992 through June 30, 1993. Both parties to said MOU
agreed to reopen the MOU for the purpose of meeting and conferring
to modify certain sections of the MOU. The modifications to the
MOU which have been agreed to by both parties are set forth herein.
said modifications to the MOU shall be effective as of July 1,
1992. Except as specified below, the remainder of the Memorandum
of Understanding remains unchanged.
1.01
Parties to Memorandum
Add the following language to section 1.01:
As of July 1, 1992, the Library clerical and technical
employees, previously represented by AFSCME, Local 1634,
shall be represented by MEA. As a result, Library
employees who hold positions in the following job
classifications will now be represented by MEA:
Administrative staff Assistant
Library Assistant
Library Inspector
Literacy Program Assistant
Staff Assistant I
Staff Assistant II
Staff Assistant III
Staff Assistant IV
With this change in representation of the Library
clerical and technical employees, the following position
classifications will be added to Exhibit A:

Definitions
current MOU language to remain unchanged
The following language will be added to subsection H, with
said language becoroing paragraph #3 of subsection H:
H.
(3) For employees covered herein who hold permanent
positions at the Library r the full time work
week shall be defined as forty (40) hours,
Monday through Saturday r as scheduled by the
City Librarian or his/her designated
representative. Sunday work shall be
compensated at the rate of time and one-half (1-
1/2) the normal hourly rate. It is the intent
of the City to assign Sunday work on a volunteer
basis. However, in the event there are not
enough volunteers to staff the Sunday work at
the Library, said work will be assigned on an
equitable basis among employees.
Salaries
Current MOU language remains unchanged. Add the following
language to the end of subsection A:

For the following classifications, the E-step salary
shown below reflects both an equity adjustment and a
cost of living increase effective July 1, 1992.

Night Differential Pay
Add the following language as subsection G:
G. In lieu of the MOU prov~slons listed in subsection A
through F of this section of the MOU, for employees
covered hereunder who hold permanent positions at the
Library, the following MOU language shall apply:
1. A night shift differential of forty (40) cents per
hour shall be paid to any line-item employee whose
regular schedule requires the employee to work
between the hours of 5:30 p.m. and 9:00 p.m.,
provided that such differential shall be paid only
for such hours worked between 5:30 p.m. and 9:00
p.m.
2. A differential of forty (40) cents per hour shall
be paid to line-item employees covered herein for
all regular hours worked in a shift which is
divided into two (2) parts by three (3) or more
hours of non-working time as a part of the
scheduled shift. Such differential shall not be
paid in addition to night shift differential or
for overtime hours beyond the scheduled shift.
Paid Holidays
Current MOD language to remain unchanged. The following
sentence is to be added following the listing of paid
holidays.
In addition, the Library shall close by no later than
5:30 p.m. on the day before the Thanksgiving holiday
and the day before the New Year's Day holiday.
IN WITNESS WHEREOF, the parties hereto have caused this amendment
to the current Memorandum of Underst;anding to be executed this
