SUBJECT Award of Contract to Replace CIVIC AudItorium Lobby and Upper
Concourse Floors
Introduction
This report recommends that the City Council award a contract to replace the CIVIC
Audltonum lobby and upper concourse floors to Des/Mar Construction. the lowest
responsible bidder. In the amount of 5279,000
Background
Dunng the FY 1996-97 budget process. the City Council approved funding to replace the
CIVIC AudItorium lobby and upper concourse floors The lobby floor area IS used
extensively d unng event intermiSSions and for concessions. exhibits and shows The
eXlstmg terrazzo floor has been worn beyond economical repair The upper concourse
floor IS located on the second level above the lobby area and IS used by the publIC durmg
events and shows The vInyl tIle floor on the upper concourse was prevIously removed due
to damage from roof leaks and replaced With temporary carpet The roof leaks have since
been repaired This proJect replaces the 7,000 square foot terrazzo floor In the lobby and
the 4.000 square foot temporary carpet floor at the upper concourse With terrazzo floonng

The design and construction documents were prepared by MOrimoto + Wldom Weln Cohen
Architects The terrazzo colors and patterns were designed by Rene Petropolrs, an artIst
selected by competitive process overseen by the Santa MOnica Arts Commission

A Notice Inviting Bids to replace the CIVIC Auditorium lobby and upper concourse floors
was published on March 10 and 11. 1997 In The Outlook, as well as In four (4) construction
Journals Bid documents were sent to SIX (6) women/mlnonty business enterpnse
associations (WMBE) Sid packages were requested by five (5) contractors The City
Clerk's Office received five (5) sealed bids at the prescnbed time The bids were publicly
opened and read aloud on March 31, 1997
The bid results were as follows

City Engineer's Estimate $400,000

Staff recommends awarding the contract to Des/Mar ConstructIon. the lowest responsible
bidder. which supplied the City with several references, all of which reported that the
Contractor's work was satisfactory The State Contractors' License Board verified that
the Contractor's license IS current, active, and In good standing
The proposed construction project Includes terrazzo flooring, which requires special
experience and qualifications by the bidder or Its subcontractor Des/Mar Construction
proposes to subcontract out 57% of the work to Corradml Corp, a subcontractor with
experience and qualifications In terrazzo work Another bidder. Spllat Construction Co ,
has filed a protest to thiS bid Since It does not comply with the requirement that a prime
contractor directly perform at least 51 % of the work However. under applIcable case law,
the subcontracting limit can be waived to allow for an inconsequential deViation from the
contract specifications and the deVIation would likely be found inconsequential The
waIver of the subcontracting process lImIt does not gIve the lowest bidder an unfair
competitive advantage In the public contracting process Additionally, waiver of the
subcontracting limit would operate to promote the goal of Insurmg economy In the public
contracting process Fmally, the terrazzo floormg IS arguably exempt from the 51 % limit
as a specialty Item

Recommendation
Staff recommends that the City Council
1 Award a contract to replace the CIVIC Auditorium Lobby and Upper Concourse floors
to Des/Mar Construction. the lowest responsible bidder, In the amount of $279.000,
and
2 Authorize the City Manager to negotiate and to execute a contract wIth Des/Mar
Construction Company, and
2 Authorize the CIty Engmeer to Issue any necessary change orders to complete
additional work In conformance with the Administrative Instructions on change
orders
