SUBJECT: REQUEST FOR RESOLUTION TO PARTICIPATE IN THE LOS
ANGELES COUNTY PARATRANSIT NETWORK
Introduction
As part of the Americans with Disabilities Act, passed by
Congress in July 1990, cities which offer fixed route transit
service must provide complementary paratransit service to
disabled individuals. In Los Angeles county, the Los Angeles
County Transportation Commission (LACTC) plans to establish,
operate and fund a countywide paratransit network to meet the
requirements of the Act. This report requests that the city
council adopt the attached resolution to participate in the
LACTC's paratransit network.
Backqround
In July 1990, Congress passed the Americans with Disabilities Act
(ADA) . One provision of the ADA requires cities which offer
fixed route transit service to provide complementary paratransit
service to those disabled individuals who cannot utilize an
accessible transit vehicle. As part of this provision, the City
is required to submit a plan to the U.s. Department of
Transportation by January 26, 1992, detailing how it will
implement the required paratransit service. In order to

encourage coordination in large metropolitan areas, specific
provisions of the ADA allow agencies, such as the LACTC, to
coordinate service, and to prepare and submit one unified
countywide plan. In order to do this, the LACTC must have
resolutions from each affected city certifying its intention to
participate in the coordinated plan.
Presently, the city uses Proposition A Local Return funds to
sponsor a paratransit system through Wests ide Independent
Services to the Elderly (WISE) . The WISE paratransit service is
available from 8:00 a.m. to 7:00 p.m. Monday through Friday,
12:00 p.m. to 3:00 p.m. on Saturday, and 9:00 a.m. to 2:00 p.m.
on Sunday. WISE serves destinations throughout Santa Monica and
a few selected activity centers outside City boundaries. Under
the LACTC Plan, the city would continue to fund WISE paratransit
service at the current level.
The LACTC paratransit network would include five zones, as shown
on the attached map. Currently, service is being implemented in
the eastern San Gabriel Valley. The Wests ide zone is scheduled
for service implementation followlng the completlon of the San
Gabriel Valley network. Under the LACTC plan, as servlce in each
zone becomes operational, disabled patrons will be able to travel
between zones without the need to transfer. paratransit service
would be available during the same hours that fixed route transit
service is available.
The proposed LACTC network will utilize the services of a broker,
who will receive ride requests from eligible disabled indlviduals
and schedule a trip on an existing public, private, or

not-for-profit paratransit servlce provider in the area. The
provider will be reimbursed for the cost of providing the trip
through the IACTC's Proposition C program. If the existing
provider cannot provide the service, the broker will arrange for
the service to be provided by a "fill-in-the-gapll overlay
provider, such as a taxicab service or an operator from a nearby
area.
There are several benefits for the city if it participates in the
Plan. The city will meet its obligation to provide and fund
expanded complementary paratranslt service, and will not be
required to prepare and submit an individual paratransit
implementation plan to the u.s. DOT. These responsibilities will
be assumed by the LACTC. By joining the proposed network, the
paratransit service above the level currently provided by the
City will be funded by the LACTC. significantly, eligible
residents will benefit since cross-jurisdictional paratransit
services to the disabled will be greatly expanded. In the
future, if the city would like to withdraw from the regional
network, it may do so, provid1ng that it prepare and submit the
appropriate plan to the DOT and undertake the expanded operating
obligations.
LACTC Responsibilities
As the coordinating agency for the paratransit Plan, the LACTC
would assume the following responsibilities:
0 Prepare and submit an interim coordinated paratransit plan
to DOT by January 26, 1992, and a countywide coordinated

plan by July 26, 1992 and update it annually thereafter
beginning January 26, 1993;
0 Develop and administer an ADA-eliglble certification and
registration process;
0 Hold public hearings as required by the ADA;
0 Develop and staff a committee comprised of disabled
individuals or agencies representing the disabled as
required by the ADA;
0 Begin implementation of the coordinated paratransit Plan;
0 Provlde funding for the cost of the ADA-mandated service
above that currently expended for disabled transportation.
By adopting this resolut1on, the City is authorlzing the LACTC to
assume its obligations to provide the complementary paratransit
service and submit the plan as required by the ADA.
City Responsibilities
As a participant in the regional para transit network, the city
agrees to assume the following responsibilities:
0 Provide relevant fiscal and operating data about its
current fixed route and paratransit services to the LACTC
in a timely manner for inclusion ln the required annual
ADA paratransit plan:

0 Participate in the development of the Los Angeles County
consolidated ADA paratransit plan due to DOT on July 26,
1992;
0 Present such Plan for the city Council adoption prior to
June 15, 1992;
0 In accordance with 49 CFR Part 37.141, the city must
maintain its current level of paratransit service,
presently provided through WISE.
BUdgetary/Financial Impact
Under ADA, the City is obligated to operate paratransit service
to complement its fixed route service. Adopting the resolution
and participating in the regional paratransit network will result
in expanded paratransit serv1ce that will be funded by the LACTC.
Recommendation
City staff recommends that the city Councll adopt the attached
resolution to participate in the Los Angeles County paratransit
network since it will allow the City to meet the complementary
paratransit provisions of the ADA in a coordinated manner, while
enhancing the level of paratransit service to the disabled
community.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA MONICA AUTHORIZING THE CITY TO PARTICIPATE
IN THE LOS ANGELES COUNTY COORDINATED PARATRANSIT NETWORK
WHEREAS, the Americans with Disabilities Act (hereinafter
referred to as It ADA It ) was enacted on July 26, 1990 (Public Law
101-336) ; and
WHEREAS, on September 6, 1991, the United States Department
of Transportatlon (hereinafter referred to as "DOTII) issued a
final rule implementing the transportation-related provlsions at
the ADA (49 CFR Parts 27, 37 and 38, Transportation for
Individuals with Disabllit1es); and
WHEREAS, Subpart f, Sections 37.121 and 37.135 of 49 CFR 37
requlres that each fixed route transit operator provide
complementary paratransit service to disabled 1ndividuals,
prepare a plan for implementation of such serVlce and begin
service implementation by January 26, 1992; and
WHEREAS, Subpart F, Section 37.141 of 49 CFR 37 allows the
preparation and submittal of a slngle coordinated paratransit
plan among the operators of f~xed route transit service Wl.th
overlapplng and contiguous service areas; and
WHEREAS, the Clty of Santa Monica (hereinafter referred to
as ItCl.tyn) operates a flxed route transit system in Los Angeles

County and 1S required to begin lrnplementation of ADA-elig1ble
complementary paratransit service and submit a paratrans1t plan
to DOT by January 26, 1992, and annually thereafter; and
WHEREAS, the Los Angeles County Transportation Comm1SS1on
(hereinafter referred to as "LACTC"), which is mandated by state
statutes to coordinate paratransit serV1ces in Los Angeles
County, has determined that the development of a countyw1de
coordinated paratransit network (hereinafter known as the
"Network" ) is the most approprlate and effective means of meetlng
the ADA obligations of the Los Angeles County fixed route transit
operators; and
WHEREAS, the LACTC has agreed to prepare the comprehens1ve
DOT-required annual coordinated paratransit plan (herelnafter
referred to as the "Plan" ) for all participating Los Angeles
County fixed route transit providers who pass resolutions
supporting the plan; and
WHEREAS, the LACTC has agreed to prepare and submlt an
inter1m plan lncluding such support resolutions to DOT by January
26, 1992, and prepare and submit the complete countywide
coordinated paratransit plan to DOT by July 26, 1992; and
WHEREAS, the LACTC has agreed to coordlnate the
implementatlon of complementary paratranslt services through the
development of a countYWlde paratransit network and begln
lmplementation of a coordlnated paratransit network to prov1de
the ADA-mandated complementary paratransit services; and
WHEREAS, the LACTC w111 provide funding for any increase In
paratransit service, above the level of elderly and disabled

translt serVlces currently malntalned by the city, WhlCh may be
requlred by the Plan; and
WHEREAS, the Clty deslres to meet lts ADA-mandated
paratransit obligatlons through participation in the coordinated
paratransit plan and network being developed by the LACTC,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES RESOLVE AS FOLLOWS:
SECTION 1- The City is committed to provide ADA
paratransit services and agrees to participate in the development
of the Los Angeles County coordinated paratransit plan to provlde
such serVlce ln conformance with the requlrements of 49 CFR Part
37 Subpart F.
SECTION 2. The Clty will make the following efforts toward
participation in the Plan:
A. Provide relevant fiscal and operatlng data (as
descr1bed ln Attachment A) about its current fixed route
and paratransJ.t servJ.ces to the LACTC in a timely manner
for incluslon in the required annual ADA paratransit plan.
B. Partlcipate ln the development of the Los Angeles
County consolidated ADA paratransit plan due to DOT on July
26, 1992.
C. Present such plan for City council adoption prior
to June 15, 1992.
D. Either adopt the consolidated paratransit plan or
prepare and submit an individual city paratransit plan
prior to July 26, 1992.

E. In accordance with 49 CFR Part 37.141, the City
will ma~ntaln current levels of paratransit service until
the coordinated plan goes ~nto effect.
SECTION 3. The Clty Clerk shall certify to the adoption of
this Resolution, and thenceforth and thereafter the same shall be
in full force and effect.
