Background On November 11. 1980, the Clty Councll refused to proceed w1th emlnent domaln proceedlng unless the project was scaled down. constructed with wood. and was unllghted. By letter dated November 20. 1980. (copy attached) the Mayor wrote Los Angeles Councllman Braude of the Council's actlon. On December 5. 1980, Clty staff met wlth Los Angeles staff. Also present were the abuttlng Los Angeles residents. VaflOUS alternatlve deslgn changes were d1scussed. It was agreed a reasonable compromlse would be to use the orlglnal concrete design but provlde a resll1ant surface to the stairs threads of elther wood, or some other materlal. None of the resldents present obJected to the llghts. Recommendation It 1S recommended the City Councl1 set January 27, 1981 as the date for a public hearlng to conslder proposed design changes to the 4th Street stairvJay north of Adelaide Dr1ve and d1rect the C1ty Manager to notify affected property owners. The Council agreed to proceed with eminent domain action to secure a landing at the top of the stairs, provided the project is scaled down, constructed from wood, and remains unlighted. I would suggest that our respective staffs meet to resolve the details as necessary. It may be possible to use wooden treads to satisfy Santa Monica and to construct the remainder of the stdirway of more durable materials requiring less maintenance to satisfy the concerns of Los Angeles. Please ask your staff to contact Stanley Scholl, Director of General Services at Santa Monica City Hall, in thlS regard. Scholl: In order to make sure that each agency (Santa }~nica and Los Angeles) has a clear, definitive understanding of the provisions agreed to at the Meeting in Councilr-an Braude's West Los Angeles District Office on December 5, 1980, (including the subsequent clarifications made in ensuing telephone conversations), I am documenting these provisions. The provisions are as follows: 1. The City of Los Angeles, (Bureau of Engineering) will modify the present design as follows: A. A resi1ent tread surface will be provided to accommodate joggers. The resi1ent surface may either be of wood or of a material applied on concrete similar to that used on the surface~ of outdoor athletic areas, (tennis courts, hand- ball courts, etc.). Des-Q-Tex is the trade name of one example of such a material. B. Although it was agreed that the present concept of providing a lightlng systeM is to be preserved, we will see if the type of lighting can be changed to SOdlUP, instead of mercury vapor. 2. Your office will arrange for the City Council of Santa Monlca, at its first meeting in January 1981, to consider the following' A. That the City Council of the City of Santa Monica finds and determines that in order to construct said publlC way. the publ1C interest, convenience and necessity require the acquisition by the City of Santa Monica of an easement in and to the real property in this section hereinafter described. That said real property is situated in the City of Santa Monica, County of Los Angeles, State of California and is more partlcu- larly described as follows: "That portion of Lot E., Tract No. 7433, as per map recorded in Book 96. That the acquisition of the easement to sald real property is necessary for the construction and development of a public walkway. D.
