Ordinance Amending Preferential Parking Zone C
At its meeting on May 22, 1984, the City Council directed
the City Attorney to prepare an ordinance amending Preferential
Parking Zone C to include Hill Street between 3rd and 4th Street.
In response to this d1rection, the accompanying ordinance has
been prepared and is presented for City Council consideration.
In connect~on with the establishment of Preferential
Park1ng Zone C an initial study was prepared in accordance with
the provislons of the California Environmental Quality Act.
Based upon th~s ~nitial study, a negative declaration was
prepared and approved. The enlargement of the zone to include
elght additional on-street parking spaces will not have a
significant
effect on the environment.
The Department of
community and Economic Development has determined that the
enlargement is categorically exempt and prepared a Not1ce of
Exemption.

AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF SANTA MONICA AMENDING SECTION 3238c
TO THE SANTA MONICA MU~ICIPAL CODE TO
ENLARGE PREFERENTIAL PARKING ZONE C
BY ADDING HILL STREET BETWEEN THIRD AND
FOURTH STREETS
WHEREAS, the Clty CounCll has adopted Municlpal Code
Sectlon 3232c establishing a preferential parklng zone in the
area bounded by Ocean Park Boulevard on the north, Third Street
on the east, the city limits on the south, and Maln Street on the
west~ and
WHEREAS, a petition has been received to enlarge the
preferential parklng zone to lnclude Hlll Street between Third
Street and Fourth Street; and
WHEREAS, the petition has been verified to be signed by
residents living ln two-thlrds of the dwelling units comprlsing
not less than 50 percent of the developed frontage of the
proposed preferential parking zone~ and
WHEREAS, the parking and Traffic Engineer has undertaken
such studles and surveys deemed necessary to determine whether a
preferentlal parklng zone should be designated ln the area~ and

WHEREAS, the City Council is satisfied that the proposed
area meets the designatlon criterla set forth in Municipal Code
Section 3232A.
NOW. THEREFORE. THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES ORDAIN AS FOLLOWS:
SECTION 1. Section 3238c is added to the Santa Monica
Municipal Code to read as follows:

Parking Zone C.
(a) The
following
named
and
described streets or portions of streets
w1thln the C1ty shall constitute
Preferent1al Parking Zone C: Second and
Thlrd Street between Ocean Park Boulevard
and the south Clty lJ.m1ts, H~ll Street
between Main street and Fourth Street,
and Beach Street. Ashland Avenue, and
Marine Street between Main Street and
Third Street. excepting therefrom the
portion of any such street directly
adJacent to a school, church. or licensed
day care fac1lity 1n other than a place
of residence and excepting therefrom any
metered park1ng spaces from use by
permi ttees.
(b) No vehicle shall be parked or
stopped adJacent to any curb in

Preferent~al Park~ng Zone C during the
hours of 6:00 p.m. to 2:00 a.m. without a
permit ~ssued and d~splayed in accordance
with this Chapter. Any vehicle parked or
stopped without a permit may be removed
from the street by any pol~ce off~cer.
(c) The annual fee for each permit
issued for Preferential park~ng Zone C
shall be $15.00 per permit or such other
fee as may be establ~shed from time to
time by resolution of the City Council.
SECTION 2. Any prov~s~on of the Santa Mon1ca Munic~pal
or append~ces thereto ~nconsistent with the provisions of
ordinance, to the extent of such inconsistenc~es and no
further, are hereby repealed or modified to that extent necessary
to affect the provisions of this ordinance.
SECTION 3. If any section, subsect~on, sentence, clause,
or phrase of this ord~nance is for any reason held to be inval~d
or unconstitutional by a dec~sion of any court of any competent
jur~sdiction, such dec~s~on shall not affect the va11dity of the
remain~ng portlons of the ord~nance. The City Counc~l hereby
declares that it would have passed this ord1nance and each and
every sect~on, subsection, sentence, clause or phrase not
declared invalld or unconstltutlonal without regard to whether
any port~on of the ord1nance would be subsequently declared
1nvalid or unconstitutlonal.

SECTION 4. The Mayor shall sign and the C~ty Clerk shall
attest to the passage of th~s ordinance. This City Clerk shall
cause the same to be published once in the off~cial newspaper
w~thin 15 days after ~ts adopt~on.
The ordinance shall become
effective after 30 days from ~ts adoption.
