AND 9129Fl OF THE SANTA MONICA MUNICIPAL CODE, PERTAINING TO VARIOUS ZONING REGULATIONS. THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES ORDAIN AS FOLLOWS: SECTION 1. Certa1n defin1tions contained ln Sect~on 9102 of the Santa Monica Municipal Code are hereby amended to read as follows: Basement 1S one or more stories wholly or partly underground. A basement shall be counted as a story for purposes of height measurement ~f over three (3) feet of 1t8 height 15 above the average grade adJacent thereto and no portion of Whlch 18 situated less than flve (5') feet from any side lot Ilne unless such portlon is entlre1y below the level of the adjacent ground. SECTION 2. Sect10n 9108B4 of the Santa Monica Municipal Code is hereby amended to read as follows: 4. Build1ng Height. Where a lot or bu~ldlng slte lS situated between two lots, one or both of which has a main dwell~ng ma~nta~n~ng a front yard less than twenty (20) feet in depth. a structure may proJect up to flve (5) feet into the front yard provided that not more than one-half (1/2) of the total width of the buildlng is so prO]ectlng and that an area equ~valent to that occup~ed by the pro]ect~ng port~on of the structure 1S provided and rnaintalned adJacent to the front yard area, the total front yard so provided to be an area equivalent to not less than twenty (20) times the wldth of the lot or build~ng s~te. Said replacement space shall have a m~nlmum d~mension, either in length or width, of eight (8) feet and shall be so located that it is suitable for general open use by the occupant of the premises. SECTION 9. Section 9ll4B2a of the Santa Mon1ca Municipal Code lS hereby amended to read as follows: a. Front Yard. A front yard shall be provided and maintained on each lot. Sald yard shall have a mlnimum depth as specified on the "dlstrlct~ng map" except that ~n no event shall the front yard be less than twenty (20) feet in depth. Except that any lot or buildlng site conta~n~ng an area of six thousand (6,OOO) square feet or less, exclusive of any alley area, shall be exempt from this provision but shall provide a front yard area as established by the dlstricting map. SECTION 10. Section 9126D of the Santa Monica Mun1c~pal Code lS hereby amended to read as follows: D. Waiver of Height L~mit. Any provision of this Code to the contrary notwlthstand1ng, except Sectlon 9126C, -7- e e height lim~ts shall be wa~ved ~n all distr~cts except res~dential distr1cts provided that ne~ther the total floor area nor the cubic content of any building or buildings erected shall exceed the max~mum WhlCh, but for thlS section could be provided with~n the height limit stated for the distrlct which ~ncludes the lot or building s~te on which sa~d building is located, provided that noth1ng in the forego~ng shall in anyway modify the provislons of Sect~on 9126C of this Code. SECTION 11. Sect10n 9127B of the Santa Monlca Munlclpal Code is hereby repealed in its entirety. SECTION 12. Section 9l27H6 of the Santa Mon~ca Municlpal Code 1S hereby amended to read as follows: 6. Open, unenclosed porches, platforms or land places, not covered by a roof or canopy, Wh1Ch do not extend above the level of the f~rst floor of the building may extend or proJect ~nto any requ~red yard space not more than six (6) feet, except that no walkway, porch, platform or landing place shall be situated less than five (S) feet from any s~de lot line unless such walkway, porch, platform or landing place lS maintained at or below the level of the adJacent grade thereto, excert that on lots of less than 55' in width, such rorches, platforms or loading spaces not above the level of the first floor and not more than 3' above average ~rade may extend to one slde lot line but not both. SECTION 13. Section 9129Fl of the Santa Monica Mun~c~pal Code ~s hereby amended to read as follows: Section 9l29Fl. Off-Street Parking Requlrements For Various Uses and Zones. Residential Districts Required Off-street Automoblle Parking Spaces. Rl District 2 covered spaces per dwelling unit. Commerclal Distrlcts CA, CP, C2, C3, C4 For bUlldLngs or addltions up to 8000 square feet of gross floor area: 1 square foot of parking area for each sguare foot of gross floor area, or, I-space for each 300 square feet of gross floor area. Theatres, Dance Halls, Convent~on Centers, Meet~ng Halls and Places of Assembly: I-space per 4 fixed seats, or I-space per 80 square feet of floor area ln places of assembly ~f no f~xed seats. Trade Schools and Business Colleges: I-space per 150 square feet of gross floor area. Schools: Elementary: IO-spaces, plus 1 addltional space per classroom. Junlor H~gh: 10-spaces, plus 1 add~tional space per classroom. H~gh School: 10-spaces, plus 15 addlt~onal spaces per classroom. Colleges: 10-spaces, plus 30 additional spaces per classroom. Industr~al Distr~ct Ml and M2 Industries: I-space per 350 square feet of gross floor area. Warehouses and Storage Buildings: I-space per 1000 square feet of gross floor area. Commercial uses: Requ~rements for commercial uses shall be the same as the requirement for commercial distrlcts. SECTION 14. Any prov1s~on of the Santa Monica Municipal Code, or appendices thereto inconsistent herew~th, to the extent of such 1nconsistenc1es and no further, are hereby repealed or modi fled to that extent necessary to effect the proVls10ns of thlS ordlnance. SECTION 15. If any section, subsect~on, sentence, clause or phrase of this ordinance is for any reason held to be invalid or unconstitutional by a deClsion of any court of competent jurisdiction, such decis10n shall not affect the validlty of the remain1ng port1ons of the ord1nance. The City Council hereby declares that it would have passed this ordinance and each and every sectlon, subsection, sentence, clause or phrase not declared inva11d or unconstitutional wlthout regard to whether any port1on of the ordlnance would be subsequently declared lnvalld or unconst1tutional. SECTION 16. The Mayor shall s1gn and the C1ty Clerk shall attest to the passage of this ordinance. The City Clerk shall cause the same to be publ1shed once in the official newspaper with1n fifteen {IS} days after 1tS adoptlon. The ordinance shall become effect1ve after th1rty (30) days from its adopt~on. " . .- ~ RESOLUTION OF THE BOARD OF DIRECTORS OF THE SANTA MONICA JAYCEES WHEREAS, the Santa Monica Jaycees have considered the proposed FINDINGS AND RECOMMENDATIONS OF THE CITY PLANNING COMMISSION OF THE CITY OF SANTA MONICA RECOM- MENDING THE AMENDMENT OF CERTAIN SECTIONS OF CHAPTER ONE, ARTICLE IX OF THE SANTA MONICA MUNICIPAL CODE RELATING TO ZONING, and WHEREAS, the Santa Monica Jaycees have concluded that in view of the fact that a Master Plan for the City of Santa Monica is now in the process of preparation, it is and would be premature to place into effect proposals such as the aforementioned in that it represents a "piecemeal" approach to resolving the real estate problems facing the City of Santa Monica matters and has a high probability of producing long range results inconsistent with the Master Plan eventually adopted for this City; and WHEREAS, it is the belief of the Santa Monica Jaycees that the City Council of the City of Santa Monica should refuse to propose, hear or enact in any manner, directly or indirectly, proposals, such as the aforesaid, which are not accompanied by and include as a part thereof an ECONOMIC IMPACT REPORT prepared by City Administration in that the -1- +.... ~ .. .~ e ~ 'J . failure to so include such vital information fails to provide concerned citizens of the City of Santa Monica with all information necessary for them to determine the overall and total impact of any such legislation; that the failure to include such vital information pro- duces a risk that citizens of this City and their chosen representatives and leaders are in many instances not made aware of the economic impact of such proposals until it is too late to act which in turn produces and/or per- petuates a feeling of lack of "good-faith" towards the Council of the City of Santa Monica and other governmental institutions. THEREFORE, BE IT RESOLVED THAT, we the Santa Monica Jaycees strongly oppose any action on the part of the City Council of the City of Santa Monica on the proposed FINDINGS AND RECOMMENDATIONS OF THE CITY PLANNING COMMISSION OF THE CITY OF SANTA MONICA RECOMMENDING THE AMENDMENT OF CERTAIN SECTIONS OF CHAPTER ONE, ARTICLE IX OF THE SANTA MONICA MUNICIPAL CODE RELATING TO ZONING in that such action is premature and represents a piecemeal approach to real pro- perty matters pertaining to the City of Santa Monica in view of the pending Master Plan for the City of Santa Monica.
